Ord 119-87 12/1/1987 t . ORDINANCE NO. 119-87 AN ORDINANCE CLOSING CERTAIN ALLEYS AND UTILITY EASEMENTS IN BLOCKS 37 & 38, JOSEPH A. KEMP ADDITION, & LOT 43 , BLOCK 1, IRRIGATION SUBDIVISION, WICHITA FALLS, TEXAS; PORTION OF COLO- RADO AVENUE, PREVIOUSLY CLOSED BY ORDINANCES 2092 & 2114; AND PORTION OF GALVESTON STREET CLOSED BY ORDINANCES 1474 & 1581. WHEREAS, certain alleys and easements previously dedicated or retained in Blocks 37 & 38, Joseph A. Kemp Addition, and Lot 43 , Block 1, Irrigation Subdivision, Wichita Falls, Texas; portion of Colorado Avenue, previously closed by Ordinances 2092 & 2114; and portion of Galveston Street closed by Ordinances 1474 & 1581; are no longer required; and, WHEREAS, the City Council of the City of Wichita Falls, Texas deems it advisable and in the public interest to close the alleys and easements hereafter described. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: SECTION 1. The twenty ( 20) foot wide east-west alleys lying south of, and abutting the south boundaries of Blocks 37 & 38, Joseph A. Kemp Addition, Wichita Falls, Texas, and bounded on the east by the west right-of-way line of Texas Avenue and extending westerly to the east right-of-way of Colorado Avenue previously closed by Ordinance 2092, and from the west right-of-way line of said Colorado Avenue to the east right-of-way line of California Avenue are hereby closed, vacated, and abandoned; subject to the retention of a utility easement on the entire area described in this section. SECTION 2. The utility easements reserved by Section 2 of Ordinance No. 1581, which amended Ordinance 1474 closing certain section of Galveston Street, is hereby closed, vacated, and abandoned. SECTION 3. The blanket sewer line easement granted by I.H. Kempner to the City of Wichita Falls, Texas by instrument recorded in Volume 244, Page 596 of Wichita County Deed Records dated September 13 , 1920 is hereby closed, vacated, and abandoned subject to the retention of all utility easements dedicated through a final plat of Lot 43, Block 1, Irrigation Subdivision, Wichita Falls, Texas, and recorded in Volume 26, Page 50 of the Wichita County Plat Records. SECTION 4. The utility easement retained by Section 2 of Ordinance 2092 which closed a portion of the right-of-way of Colorado Avenue as originally dedicated in the Joseph A. Kemp Addition, an addition to the City of Wichita Falls, Wichita County, Ad Y Texas, the herein being more specifically described by metes and bounds as follows: r R . BEGINNING at the southwest corner of Colorado Ave. as originally dedicated, said corner lying in the south line of the J.A. Scott Survey No. 11 and the south line of the above mentioned Joseph A. Kemp Addition, said corner being further identified as being the common corner with the southeast corner of a 20 foot wide alley lying along the south side of Block 38 of the aforementioned Joseph A. Kemp Addition; THENCE N 00° 08 ' 55" W along the west right-of-way line of Colorado Ave. as originally dedicated a distance of 540. 06 feet; thence N 89° 51' 05" E a distance of 30. 00 feet; thence S 00° 08 ' 55" E 110.00 feet; thence N 89° 51' 05" E a distance of 30.0 feet to the east right-of-way line of Colorado Ave. as originally dedicated; thence S 00° 08 ' 55" E along the east right-of-way line of Colorado Ave. a distance of 429. 62 feet to the south line of the above mentioned Joseph A. Kemp Addition and the south line of the aforementioned J.A. Scott Survey No. 11; thence S 89° 26 ' W along the south line of the aforementioned Joseph A. Kemp Addition and the south line of said J.A. Scott Survey No. 11 a distance of 60.00 feet to the Place of Beginning; less and except the following two tracts in which utility easements are still retained: ( 1) The south 50 feet of the above described tract. ( 2) A tract which will be a 20 foot wide easement in the old right-of-way of Colorado Ave. extending from the alley right- of-way in Block 31 of the above mentioned Joseph A. Kemp Addition to the alley right-of-way in Block 32 of said addition; said easement being more specifically described as follows: beginning at the southeast corner of Lot 7, Block 31 of the Joseph A. Kemp Addition, thence N 89° 26 ' E a distance of 60. 0 feet to the southwest corner of Lot 1, Block 32 of said Joseph A. Kemp Addition; thence S 00° 08 ' 55" E along the East side of Colorado Ave. right-of-way to the northwest corner of Lot 14, Block 32 a distance of 20.0 feet; thence S 89° 26 ' W a distance of 60.0 feet to the Northeast corner of Lot 8, Block 31; thence N 00° 08 ' 55" W along the west right- of-way of Colorado Ave. a distance of 20. 0 fe-t to the Place of Beginning; be and the same is hereby closed, vacated and a,anioned.
