ORDINANCE NO. 121-87
ORDINANCE AMENDING SECTION 20-23 OF THE CODE
OF ORDINANCES, WHICH REGULATES ADULT BOOKSTORES,
ADULT MOTION PICTURE THEATERS AND NUDE HUMAN
MODELING STUDIOS, TO INCLUDE OTHER SEXUALLY
ORIENTED BUSINESSES OFFERING CERTAIN LIVE
PERFORMANCES; DECLARING AN EMERGENCY.
WHEREAS, the City Council finds that bars, nightclubs and
other similar commercial establishments that offer as
entertainment, for the purpose of providing sexual stimulation
to the customers of such establishment, the hereinafter described
live performances, tend to increase crime, reduce property values
in nearby residential and commercial neighborhoods, promote urban
blight and create a corrupt influence on minors in neighboring
areas, and that the location of such establishments should be
regulated.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. Subsection (A) of Section 20-23 of the Code of
Ordinances is hereby amended by adding a new paragraph ( 5) which
shall read as follows:
" ( 5) A bar, nightclub or other similar commercial
establishment that offers as entertainment, for the purpose of
providing sexual stimulation to the customers of such
establishment, live performances by a person or persons who
expose specified anatomical areas or who perform specified sexual
activities."
SECTION 2. Whereas it appears to the City Council that a
number of establishments of the type described in this ordinance
are being planned for location in and near residential and other
sensitive areas, this ordinance is declared to be an emergency
measure on the ground of urgent public need for the preservation
of the peace, health and safety of property of the Cit , and it
shall go into effect immediately upon its passage.
