MAKING AN APPROPRIATION FROM THE
FLEET MAINTENANCE INTERNAL SERVICE
FUND IN ORDER TO SETTLE A COURT
JUDGMENT RELATING TO CONDEMNATION
OF PROPERTY FOR THE CENTRAL SERVICES
COMPLEX
WHEREAS, a Court judgment has been entered against the City
in Cause No. 122,766-A, in the 30th District Court of Wichita
County, Texas, entitled City of Wichita Falls vs. Marvin M. Burrus
and wife; and
WHEREAS, such judgment requires the City to pay an additional
$155,723 .24 plus 10% interest per annum compounded daily from
April 15, 1982 to December 15, 1987; and
WHEREAS, the total sum of $249, 000 is currently due and
payable to satisfy such judgment; and
WHEREAS, the Fleet Maintenance Internal Service Fund is
primarily responsible for this expenditure and has the required
amount available in equity.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WICHITA FALLS, TEXAS, THAT:
Section One. There is hereby appropriated from the Fleet
Services Internal Service Fund the amount of $236,716.27 to be
placed in account number 71-650-5110 to satisfy a Court judgment
relating to condemnation of property for the Central Services
Complex.
Section Two. A grave public necessity exists, and this is an
emergency expenditure to meet unusual and unforeseen conditions
which could not, by reasonable, diligent thought and attention,
have been included in the 1987-88 budget. Since these f nds are
immediately due and payable, this ordinance is declared o be an
emergency measure, and it shall become e fective imme•i- ely .on
its passage.
