Ord 018-88 2/16/1988 ORDINANCE NO. /1-fl ORDINANCE REPEALING SECTION 2-10 OF THE CODE OF ORDINANCES (ORDINANCE NO. 3615) WHICH ESTABLISHED A CONSERVATION COMMITTEE TO DETERMINE REQUESTS FOR EXEMPTIONS FOR DECORATIVE OUTDOOR GAS LIGHTS. WHEREAS, in Section 402 of Public Law 95-620 ( 42 U.S.C. 8372) , Congress prohibited the installation of outdoor lighting fixtures using natural gas, and prohibited any local distribution company (unless an exemption was obtained) from providing natural gas service for use in outdoor lighting (other than certain outdoor lighting fixtures which were installed before November 9, 1978) ; and, WHEREAS, under this federal law, the authority to grant exemptions to these prohibitions was delegated to incorporated cities in the State of Texas; and, WHEREAS, on February 19, 1980, the Wichita Falls City Council adopted Ordinance No. 3615, which established a Conservation Committee, whose responsibility and authority was to hold hearings and determine whether to grant or deny exemptions to the prohibition on the use of natural gas for such outdoor lighting; and, WHEREAS, in 1987, Congress adopted Public Law 100-42, which, among other things, repealed Section 402 of Public Law 95-620; therefore, the Conservation Committee established by Ordinance No. 3615 no longer serves any purpose.
