ORDINANCE NO. 27-88
AN ORDINANCE EXTENDING THE CITY LIMITS OF THE
CITY OF WICHITA FALLS, BY ANNEXING CERTAIN
TRACT OF LAND ADJACENT TO THE TERRITORIAL
LIMITS OF THE CITY OF WICHITA FALLS, TEXAS,
WHICH TRACT OF LAND AND SERVICE PLAN FOR SUCH
TRACT OF LAND ARE DESCRIBED IN THIS ORDINANCE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
WICHITA FALLS, TEXAS THAT:
SECTION 1. TRACT DESCRIPTION: The following tract of
land located in Wichita County, Texas, be and the same is hereby
ordered to be annexed and to be included within the corporate
limits of the City of Wichita Falls, Texas, and the corporate
limits be extended so as to include said tract of land in Wichita
County, Texas, the same being more specifically described as
follows:
A TRACT OF LAND out of the Green Reynolds Survey, Abstract 251,
Wichita County, Texas, and described as follows:
BEGINNING at a point on the present city limits which is 25 feet
south of the southwest corner of Block 3 , Cherokee County School
Land and on the south right-of-way of Rathgeber Road;
THENCE south 89° 08 ' east 1065 . 6 feet with the present city
limits as annexed by Ordinance 3569 along the south line of
Rathgeber Road;
THENCE south 00° 45 ' west 200. 0 feet along the west line of
Crestview Memorial Road and the present city limits as annexed by
Ordinance 3569;
THENCE south 89° 08 ' east 25. 0 feet to the center of Crestview
Memorial Road;
THENCE south 00° 45 ' west 2554. 6 feet to the southeast corner of
the Crestview Memorial Cemetery property;
THENCE north 89° 01 ' west 2871. 5 feet along the south line of
Crestview Memorial Cemetery to its southwest corner;
THENCE north 00° 53 ' east 2774. 4 feet with the west line of
Crestview Memorial Cemetery, crossing State Highway 79 to a point
in the centerline of Rathgeber Road and on the south line of the
present city limits as annexed by Ordinance 1897;
THENCE south 89° 08 ' east 1341. 8 feet along the centerline of
Rathgeber Road, crossing State Highway 79, and on the present
south city limits as annexed by Ordinances 1897 and 2598 to a
point on the city limits as annexed by Ordinance 3569;

THENCE south 47° 05 ' west 37.0 feet along the city limits as
annexed by Ordinance 3569 to the south line of Rathgeber Road;
THENCE south 89° 08 ' east 459. 4 feet along the south line of
Rathgeber Road and the city limits as annexed by Ordinance 3569
to the place of beginning and containing 181.86 acres of land.
SECTION 2.0. SERVICE PLAN: This service plan for
annexation of property to the City of Wichita Falls, Texas, has
been prepared by the Planning Department of the City of Wichita
Falls in conformance with the requirements of Chapter 43 ,
Subchapter C, Section 43 . 056, Texas Local Government Code:
SECTION 2. 1: SERVICES TO BE PROVIDED WITHIN SIXTY (60)
DAYS. A. Police Protection. Police protection will be provided
by the Wichita Falls Police Department within sixty (60) days of
the effective date of annexation, using existing personnel and
equipment.
B . Fire Protection. Fire protection will be provided by
the Wichita Falls Fire Department within sixty ( 60) days of the
effective date of annexation using existing personnel and
equipment. Primary service will be provided by Fire Station No.
4, which has a response time of 5.0 minutes. Back-up service
will be provided by Station No. 3 with a response time of 8.0
minutes. Secondary back-up will be provided by Station No. 8
with a response of 9 minutes.
C. Solid Waste Collection. Solid waste collection shall
be provided by the City of Wichita Falls Sanitation Division in
accordance with Chapter 17: "Garbage, Refuse, Rubbish and
Trash," Code of Ordinances, City of Wichita Falls within sixty
( 60) days of the effective date of annexation.
D. Maintenance of Water and Waste Water Facilities.
Maintenance of water and waste water facilities shall be the
responsibility of the developer for a period of one (1) year
following acceptances of said facilities by the city. Following
the one ( 1) year period of obligation of the developer, the City
of Wichita Falls Public Utilities Department shall assume all
responsibility for maintenance of water and waste water
facilities from thence forward, in accordance with Chapter 32:
"Water and Sewers, " Code of Ordinances, City of Wichita Falls.
E. Maintenance of Roads, Streets and Alleys. Maintenance
of roads, streets and alleys shall be the responsibility of the
developer for a period of one ( 1) year following the acceptance
of said facilities by the city. Following the one (1) year
period of obligation of the developer, the City of Wichita Falls
Public Works Department shall assume all responsibility for
maintenance of the roads, streets, and alleys from thence
forward, in accordance with Chapter 27 : "Streets and Sidewalks,"
Code of Ordinances, City of Wichita Falls.
SECTION 2. 2: CAPITAL IMPROVEMENTS. All capital
improvements including, but not limited to, streets, alleys,
water service lines, waste water service lines, and fire
hydrants, shall be constructed by the developer of the tract in
accordance with Appendix A "Comprehensive Subdivision Ordinance,"
Code of Ordinances, City of Wichita Falls.
SECTION 3 . 0: PUBLIC HEARINGS. In conformity with
Chapter 43, Subchapter C, Section 43 . 052, Texas Local Government
Code, before these annexation proceedings were instituted, public
hearings were held February 10, 1988 and February 16, 1988 to
provide an opportunity for all interested persons to be heard;
these hearings were held not more than forty ( 40) days nor less
than twenty ( 20) days prior to the institution of these
annexation proceedings. Notices of the public hearings were
published once each in the Wichita Falls Times/Record News not
more than twenty ( 20) days nor less than ten ( 10) days prior to
each hearing.
SECTION 4 . 0: INTRODUCTION OF ORDINANCE. In conformity
with Section 3-A of the amended charter of the City of Wichita
Falls, Texas, this ordinance was introduced on the 15th day of
March, 1988 and published in a newspaper of general circulation
in the City of Wichita Falls, Texas, to wit, the Wichita Falls
Times/Record News, one ( 1) time, on the 25th day of March, 1988,
and seven (7) days having elapsed since such publication, this
ordinance is finally passed and approved this the 5th day of
April, 1988.
