Ord 039-88 4/5/1988 Ordinance No. 39-88 AN ORDINANCE AMENDING THE ZONING ORDINANCE TO CLARIFY THE DEFINITION OF PRIVATE CLUB AND THE REGULATIONS FOR ESTAB- LISHMENTS HOLDING PRIVATE CLUB REGISTRATION PERMITS UNDER THE TEXAS ALCOHOLIC BEVERAGE CODE AND REGULATING THEM IN A SIMILAR MANNER AS ESTABLISHMENTS THAT HAVE ON-PREMISE ALCOHOLIC BEVERAGE SALES WHEREAS, the Planning and Zoning Commission has deemed that establishments holding private club registration permits under the Texas Alcoholic Beverage Code have similar land use impacts as establishments that sell alcoholic beverages for on-premise consumption; and, WHEREAS, the Planning and Zoning Commission has recommended that the Zoning Ordinance be amended to clarify the definition of private clubs and their regulations; and, WHEREAS, the City Council of the City of Wichita Falls, Texas deems it advisable and in the public interest to amend the Zoning Ordinance hereunder described. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: SECTION 1. Sections 5400 and 5420 ( 1) & ( 2) of the Zoning Ordinance are hereby amended to read as follows: "5400 ALCOHOLIC BEVERAGE SALES AND SERVICE" "5420 AUTHORIZED SALE AND SERVICE TYPES AND PERMITTED ZONES There shall be five ( 5) types of permitted alcoholic beverage sales and service in areas where such sales and service are permitted by law: 1. ON-PREMISE PRIMARY USE SALES AND SERVICE: Sales of alcoholic beverages, and service of alcoholic beverages in private clubs holding private club registration permits under the Texas Alcoholic Beverage Code, as a primary use for consumption on the premise where sold or served. Such sales and services are authorized in the HC, RDD, and CBD zones. Such sales and service are also authorized in the GC zone subject to the Conditional Use approval process in Sec. 7200 . 2. ON-PREMISE INCIDENTAL USE SALES AND SERVICE: Sales of alcoholic beverages, and service of alcoholic beverages in pri- vate clubs holding private club registration permits under the Texas Alcoholic Beverage Code, as an incidental use for consump- tion on the premise where sold or served. Such sales and service are also auth- orized in the RMU zone subject to the Conditional Use approval process in Section 7200. " `SECTION 2.
