AN ORDINANCE CLOSING, VACATING, AND ABANDONING A PORTION
OF A TWENTY ( 20) FOOT WIDE NORTH-SOUTH ALLEY IN BLOCK 37,
BARWISE & JALONICK ADDITION, WICHITA FALLS, TEXAS, AND
RETAINING A DRAINAGE AND UTILITY EASEMENT
WHEREAS, the Planning & Zoning Commission has recommended
the closure of a portion of a twenty foot wide alley in Block
37, Barwise & Jalonick Addition, Wichita Falls, Texas, subject
to the retention of a drainage and utility easement; and,
WHEREAS, the City Council of the City of Wichita Falls,
Texas deems it advisable and in the public interest to close,
vacate, and abandon the alley hereafter described.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. A portion of a twenty (20) foot wide, north-
south alley, lying in Block 37 of the Barwise & Jalonick
Addition, Wichita Falls, Texas, and bounded to the east by the
west lot lines of Lots 9-12, Block 37 ; to the west by the east
lot lines of Lots 5-8, Block 37; to the south by the north
right-of-way line of Jalonick Street; and the north by the
south right-of-way line of a twenty ( 20) foot wide east-west
alley;
be and the same is hereby closed, vacated, and abandoned.
SECTION 2. The entire area of the closed alley described
in Section 1 is hereby retained as a drainage and utility
easement, for the purposes of laying and maintaining all kinds
and character of drainage improvements and utility lines,
including water, gas, electric, telephone, T.V. cable, power
lines, and sanitary and storm sewers.
