Ord 064-88 5/31/1988 Ordinance No. 64-88 AN ORDINANCE AMENDING THE ZONING ORDINANCE TO CREATE A LIMITED OFFICE ZONING DISTRICT WHEREAS, the Planning & Zoning Commission has recommended that a Limited Office zoning district be created; and, WHEREAS, the City Council of the City of Wichita Falls, Texas deems that the proposed amendment is in conformance with the Compre- hensive Land Use Plan and is in the public interest. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: SECTION 1. Section 3000 of the Zoning Ordinance of the City of Wichita Falls, Texas is hereby amended to add the following in numerical order: "3360 LO LIMITED OFFICE DISTRICT 3361 PURPOSE The purpose of the Limited Office district is to encourage small office development of high character in a generally non commercial environment. The offices allowed in the Limited Office district have relatively low traffic generation characteristics, require limited identification by signs, and are intended to buffer residential uses from more intensive non-residential uses and non-residential streets. 3363 PERMITTED USES The following use is permitted in an LO district. Commercial Use - Offices 3364 CONDITIONAL USE The following use is permitted in the LO district subject to the approval process provided in Section 7200. Civic uses - Religious assembly 3365 DEVELOPMENT REGULATIONS Each site in an LO District shall be subject to the following develop- ment regulations: 1. Lot area: 5,000 square feet minimum 2. Lot width: 50 ft. minimum 3 . Front setback: 25 ft. minimum -2- 4. Side setback interior: 5 ft. 5. Side setback exterior: 25 ft. 6. Rear Setback: 5 ft. , minimum. 7. Height: 1 story maximum not exceeding 25 ft. 8. Building Coverage: 40% of lot area, maximum Note: See Section 4600 for buffering requirements. 3366 SPECIAL CONDITIONS 1. Hours of operation shall be limited to no earlier than 6: 00 a.m. and no later than 11: 00 p.m. 2. Lighting. All outdoor lighting is limited to a maximum of 12 ft. in height and must be directed away from residential areas. 3367 SIGN REGULATIONS: A. On-Premise Ground Signs: On-premise ground signs shall be permitted in accordance with the following regulations: 1. Maximum area: 30 sq. ft. 2. Maximum height: 3 feet. 3 . Maximum number: 1 per lot. Note: Signs shall not obstruct view to motorists and pedestrians and meets the requirements of Sec. 29-215 of the Wichita Falls Code of Ordinances as amended. B. On-Premise Wall Signs: On-premise wall signs shall be permitted in accordance with the following regulations: 1. Maximum area: 30 sq. ft. 2. Maximum number: 1 per business. C. Miscellaneous Signs: Construction, directional, nameplate, and real estate signs shall be allowed as per the provisions of Table 6741 . " SECTION 2. Section 2030, Office, of the Zoning Ordinance of the City of Wichita Falls, Texas is hereby amended to read as follows: "OFFICE A room, studio, suite, or building or any part thereof in which a person provides professional/consulting services or which is primarily used for the provision of executive, management, or administrative services. This definition shall not include offices which are related to and accessory to other on-site uses. An office shall not involve on-site manufacturing, fabrication, production, processing, assembling, cleaning, testing, repair, or storage of materials, goods and products; or the sale and delivery of any materials, goods or products which are physically located on the premises. Furthermore, an office shall not be used as a place of congregation for work off the premises. " k -3- . SECTION 3 . Section 3010 of the Zoning Ordinance of the City of Wichita Falls, Texas is hereby amended to read as follows: "3010 ZONING DISTRICTS ESTABLISHED The City of Wichita Falls is hereby divided into the following zoning districts: SEC. MAP NO. CODE ZONING DISTRICT NAME 3040 SF-1 Single-Family Residential (Large Lot) 3100 SF-2 Single-Family Residential (Standard lot) 3170 MFR Multi-Family Residential 3250 RMU Residential Mixed Use District 3320 MHR Mobile Home Residential 3360 LO Limited Office District 3370 LC Limited Commercial District 3450 GC General Commercial District 3510 HC Heavy Commercial District 3580 HI Heavy Industrial District Special Purpose Zoning Districts 3640 PUD Planned Unit Development 3700 RDD River Development District 3780 CBD Central Business District 3840 BA Brook Avenue District" SECTION 4. Section 4320A of the Zoning Ordinance of the City of Wichita Falls, Texas is hereby amended to read as follows: "A. Church spires or steeples, flagpoles, and amateur radio transmitting antennas may project beyond the maximum allowable height. However, flagpole heights shall not exceed thirty-five ( 35) feet in SF-1, SF-2, MFR, LO, LC, & BA zones and eighty ( 80) feet in all other zones, measured from the ground. Additionally, any lighting must be from the base of the flagpole and directed away from all residences. " SECTION 5. Table 6741, Note 5 of the Zoning Ordinance of the City of Wichita Falls, Texas is hereby amended to add the following para- graph at the end of the subsection. "See specific zoning district regulations in Section 3000 for additional sign regulations for LO, LC, RDD, and BA zoning districts. " L -4- SECTION 6. Section 6820 of the Zoning Ordinance of the City of Wichita Falls, Texas is hereby amended to read as follows: "6820 APPLICABILITY Landscaping Regulations shall apply to all uses other than single- family, duplex, and zero lot-line residential uses, in the SF-1, SF-2, MFR, RMU, LO, LC, GC, HC, HI, RDD, BA zoning districts, and also in the Central Business District if a setback area is provided. Landscaping requirements for the River Development District and Brook Avenue District shall meet the requirements of Sections 3750 and 3843 respectively, and may be greater than the requirements set out in this section. A final certificate of occupancy may be issued without the required landscaping in place provided, that assurances are given in writing as to the date when landscaping will be installed. All landscaping shall be installed no later than 6 (six) months after the issuance of the certificate of occupancy. " PASSED AND APPROVED THIS THE 31st day of May, 1988.
