Ord 068-88 5/31/1988 ORDINANCE NO. (P‘--Id( ORDINANCE ESTABLISHING A COMMISSION FOR DISABLED PERSONS WHEREAS, on May 19, 1987 the City Council of the City of Wichita Falls passed a resolution creating a Task Force on the Handicapped to study problems of disabled persons, and to begin to form a Commission For Disabled Persons, and WHEREAS, the Task Force on the Handicapped completed its study and presented a report to the City Council at the City Council meeting on May 3, 1988 recommending that the City Council establish a Commission For Disabled Persons, and WHEREAS, the Task Force on the Handicapped determined that the establishment of a Commission for Disabled Persons with the goal of greater development of community based service for the handicapped would represent a progressive step towards addressing the needs, problems and positive options for the handicapped of the Wichita Falls community, and WHEREAS, the Task Force on the Handicapped determined the purpose of a Commission For Disabled Persons would be to: Promote better public understanding concerning the abilities as well as the needs of persons with disabilities Monitor and maximize the availability and use of present services to the disabled Contest the erosion of service levels Identify needs of the disabled that are inadequately met Encourage the development of existing community resources and solicit further such resources to assist in meeting the needs of the disabled Focus attention on practical solutions to maintain and increase funding for essential services to the disabled Conduct appropriate studies to enhance the understanding of needs and the resources to meet the needs of persons with disabilities Support present services by encouraging volunteerism 4 Examine specific needs and requests related to disabled persons and make recommendations to the City Council NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: Section 1. Creation. There is hereby established a Commission For Disabled Persons, which shall address the needs, problems and positive options for the handicapped of the Wichita Falls community. The commission shall consist of seventeen members. Section 2. Qualifications of Members. of the commission shall be appointed by the Members Pp Y City Council and shall serve without compensation. Members shall be residents of the City of Wichita Falls and shall be committed to the goals of the commission. Members, while serving, shall not hold governmental elective office. Section 3 . Representation. In appointing the Commission for Disabled Persons the City Council shall consider representative citizens who meet the following qualifications: ( 1) industry--producer or manufacturer, ( 2 ) business--retailer, wholesaler, industrial distributor ( 3 ) consumer services--utilities, rentals, child care, etc. ( 4) financial institutions--bank, savings and loan, insurance, etc. ( 5) the medical community ( 6) the professional community--accountant, architect, attorney, etc. (7) education--any level ( 8) local government ( 9) religious community (10) military ( 11) labor--carpenter' s union, electrical workers union, etc. ( 12) the news media--newspaper, television, radio ( 13 ) service providers to the disabled--agencies ( 14 ) service providers to the disabled--organizations ( 15 ) the disabled community--disabled adult ( 16) the disabled community--parent/guardian of disabled individual, ( 17) The Handicapped Awareness Week Committee Section 4. Terms of Office. Initially, nine ( 9) members of the commission shall be appointed for a term of one ( 1) year expiring May 31, 1989 and the remainder shall be appointed for a term of two ( 2) years expiring May 31, 1990 in order to maintain continuity of the commission. Thereafter, each member of the commission shall be appointed for a term of two ( 2) years expiring May 31 or until a successor is named. Appointments to fill any vacancy on the commission shall be made by the Council and that member shall serve for a remainder of the unexpired term of office. When any member of the commission fails to attend three ( 3 ) consecutive meetings without due cause, the chairperson shall certify the same to the City Council. Such member shall then be deemed to have been removed and a vacancy created. No member shall serve on the commission more than three ( 3 ) consecutive terms. Section 5. Organization of the Commission. The members of the commission shall elect a chairperson and vice chairperson for one ( 1) year terms and such other officers as may be deemed necessary or desirable, who shall serve at the will of the commission. The chairperson shall have a vote equal to that of the other members of the commission. Nine ( 9) members of the commission shall constitute a quorum. The commission shall meet at least four ( 4 ) times during a calendar year. The chairperson may call meetings of the commission, and meetings may be called by written notice postmarked ten ( 10) days in advance and signed by nine ( 9) members, and the commission at any meeting may fix and call a meeting on a future date. Minutes shall be kept of all meetings of the commission and shall be regularly sent to the City Council. All meetings shall be public. Section 6. Duties and Powers of the Commission. The commission shall have the following duties, functions, powers and responsibilities: (a) To serve in an advisory capacity to the City Council in respect to all matters pertaining to the general welfare and advancement of the handicapped, including but not limited to legal and civil rights, health care, appropriate accommodation, maintenance for independent living, economic status, community access, employment, political opportunity, quality of life and preventative support systems. (b) To conduct public outreach efforts, including but not limited to surveys, public hearings, seminars and informational programs, in order to gain information on r • `r the needs of the handicapped and to make findings and recommendations to the Mayor and the City Council. (c) To appoint at its discretion subcommittees to concern themselves with specific problems relating to the handicapped and to formulate and recommend plans and programs. Subcommittees shall be chaired by commission members. (d) To perform such other duties as may from time to time be assigned to it by resolution of the City Council. Section 7. Limitation of Powers. The powers and jurisdiction of the commission shall be purely advisory, voluntary and persuasive. The commission shall not have any power of authority to subpoena or compel the attendance of witnesses. The commission shall have no power to appoint city officers or employees or to make policy decisions, or to manage, control or administer institutions relating to the handicapped in Wichita Falls. Section 8. Severability. If any section, subsection, sentence, clause or provision of this ordinance is held invalid, the remainder of this ordinance shall not be affected by such invalidity.
