AN ORDINANCE WAIVING THE WORDS "AUTO PARTS" FROM THE
FIRST SENTENCE OF SECTION 19*-3 , SUBSECTION (b) , PARA-
GRAPH ( 4) OF ORDINANCE NO. 45-88, ALLOWING THE FRONT
FENCE, LOCATED AT TEXAS AUTO SALVAGE, 4104 IOWA PARK
ROAD, TO REMAIN AS PRESENTLY CONSTRUCTED OF SALVAGE
WHEELS AND WHEEL COVERS ( "HUBCAPS" ) .
WHEREAS, Ordinance No. 45-88, adopted on April 19, 1988,
presently prohibits the use of auto parts as materials allowed
for fencing of outdoor storage yards; and,
WHEREAS, the front fence at Texas Auto Salvage, owned by
Mr. C.E. Henry, presently consists of auto wheels and wheel
covers; and,
WHEREAS, the unique character of the Texas Auto Salvage
fence has been in existence for twenty-two ( 22) years and has
become a trademark for Texas Auto Salvage; and,
WHEREAS, Mr. Henry has requested that a waiver of the
ordinance, in reference to the prohibition of the use of auto
parts, be granted for this location, and the City Council
finds that the circumstances involved in this request are
exceptional.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WICHITA FALLS, TEXAS, THAT:
The words "auto parts" , of the first sentence of Section
19*-3 , Subsection (b) , paragraph ( 4) of Ordinance No. 45-88,
be waived for Texas Auto Salvage, located at 4104 Iowa Park
Road to allow the existing fence of "hubcaps" to remain.
