Resolution approving filing of application for amendment of water
right pursuant to Certificate of Adjudication No. 02-5150 to allow the
City’s reuse of return flows associated with an application to amend
TPDES Permit No. WQ0010509001
WHEREAS, the City of Wichita Falls, Texas (the “City”) holds rights to divert and
use state water pursuant to Certificate of Adjudication No. 02-5150 (the “Certificate”);
WHEREAS, pursuant to the Certificate the City provides water to its citizens and
customers for municipal purposes;
WHEREAS, the City desires to amend its Certificate to be able to reuse its future
return flows associated with an application to amend TPDES Permit No.
WQ0010509001; and
WHEREAS, the Texas Water Code and the Rules of the Texas Commission on
Environmental Quality (the “Commission”) require proof of authorization to execute and
prosecute an application for an amendment to the Certificate on behalf of the City;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
1. The Director of Public Works is hereby authorized on behalf of the City Council
to execute such applications as are necessary to be filed with the Commission to
amend Certificate of Adjudication No. 02-5150 to allow the City’s reuse of return flows
associated with an application to amend TPDES Permit No. WQ0010509001.
2. The Director of Public Works is hereby authorized and directed on behalf of
the City Council to file said applications and any associated documents and to appear
and arrange for the appearances of persons representing the City at the hearings and
other proceedings on the application before the Commission, and otherwise direct
prosecution of the application and related matters on behalf of the City Council.
