Min 04/01/2014 CITY COUNCIL MINUTES April 1, 2014 Page 1 CITY COUNCIL MINUTES Wichita Falls, Texas Memorial Auditorium Building April 1, 2014 Item 1 - Call to Order The City Council of the City of Wichita Falls, Texas met in regular session on the above date in the Council Chambers of the Memorial Auditorium Building at 8:30 o’clock a.m., with the following members present. Glenn Barham - Mayor Tim Ingle - Councilors Ben Hoover Annetta Dotson - Michael Smith - Brian Hooker - Mary Ward - Darron Leiker - City Manager Miles Risley - City Attorney Tracy Norr - City Clerk - - - - - - - - Mayor Barham called the meeting to order. - - - - - - - - Item 2a - Invocation Jeremy Wittwer, Pastor of Central Christian Church, gave the invocation. - - - - - - - - Item 2b - Pledge of Allegiance Mayor Barham led in the Pledge of Allegiance. - - - - - - - - Item 3a -Employee of the Month Wade Looney, auto services coordinator, recognized Edmond Yelle as the Employee of the Month. Mayor Barham presented a plaque, a letter of appreciation, restaurant tickets, and a check to Mr. Yelle and thanked him for his service. - - - - - - - - CITY COUNCIL MINUTES April 1, 2014 Page 2 Item 3b - Proclamation DeAnna Booker highlighted the volunteer activities of the National Senior Volunteer Center. Mayor Barham read a proclamation establishing April 1, 2014 as National Service Recognition Day in Wichita Falls. - - - - - - - - Item 3c - Proclamation Mayor Barham read a proclamation establishing April 2014 as Child Abuse Prevention and Awareness Month and encouraged citizens to unite against child abuse. Debra Choate highlighted the events for the awareness month - - - - - - - - Item 3d - Proclamation Mayor Barham read a proclamation establishing April 2014 as Safe Digging Month in Wichita Falls. Randy West of the Atmos Energy management team encouraged people to call 8-1-1 before digging more than 12 inches deep. - - - - - - - - Item 3e - Proclamation Mayor Barham read a proclamation establishing April 7-13, 2014 as National Public Health Week in Wichita Falls. He encouraged everyone to embrace healthier lifestyles. Lou Kreidler thanked the staff at the health district for their work in protecting the citizens of Wichita County. She invited participation in the annual health fair. - - - - - - - - Item 4- Comments from the Public to Members of the City Council Concerning Items That Are Not on the City Council Agenda. Gonzalo Robles, 2403 McNeil Avenue, spoke regarding the Café Leche, which helps minority students go to post-secondary education. He reviewed the percentages of Hispanic students who have applied for FAFSA this year. He asked for support in promoting the advantages of post-secondary education. David Barbosa, 2428 Brentwood Drive, spoke about the Hispanic Education Summit that will be held in Wichita Falls. He invited the council to participate in the summit. - - - - - - - - Item 5 – 6a– Consent Items City Manager Darron Leiker gave a briefing on the items listed under the Consent Agenda. He asked that Item 6a be pulled from the consent items for approval at a later meeting. CITY COUNCIL MINUTES April 1, 2014 Page 3 Moved by Councilor Smith that the Consent Agenda be approved. Nays: None Item 5 - Approval of Minutes of the March 18, 2014 Regular Meeting of the Mayor and City Council Item 6a – Resolution 39-2014 Resolution 39-2014 Resolution Appointing a Representative (Dana Ross) to the Wichita-Wilbarger 9-1-1 District Board - - - - - - - - Item 7a – Ordinance No. 11-2014 ORDINANCE NO. 11-2014 Ordinance Amending the Code of Ordinances of the City of Wichita Falls to Add Division 6 to Article III of Chapter 14 thereof to Regulate Breeding, Sale, and Transfer of Dogs and Cats, to Modify Section 14-147 to Alter the Definition of a Pet Shop, to Modify Section 14-310 to Require Spaying or Neutering for Retrieving Previously Reclaimed Animals, and to Modify Section 48-94 to Provide Fees for Added Permits; Providing a Penalty Not To Exceed $500 Upon Conviction; and Providing for Codification Moved by Councilor Hooker that Ordinance No. 11-2014 be passed. Motion seconded by Councilor Dotson. Walter King, 3101 Cumberland, asked if the ordinance only applies to dogs and cats. He asked about military or elderly persons who need to give away a permit. He said a lot of people will dump the unwanted animals. Ms. Kriedler said the ordinance only applies to puppies and kittens, not adult animals. Kendra Maroney, #3 Beckindale Court, spoke in support of the ordinance. She said the people who are contributing to the over-population of pets should be financially responsible, rather than the taxpayers. The motion carried by the following vote: Ayes: Mayor Barham, Councilors Ward, Dotson, Ingle, Smith, Hooker, and Hoover. City Council reconvened at 9:42 a.m. The Mayor announced that no polls or votes were taken during Executive Session. - - - - - - - - Item 7b – Ordinance No. 12-2014 ORDINANCE NO. 12-2014 Ordinance Appointing Larry Gillen as Municipal Judge for a Two-Year Term to Begin on May 21, 2014 Moved by Councilor Hooker that Ordinance No. 12-2014 be passed. Motion seconded by Councilor Smith. Motion amended by Councilor Ingle to clarify that this appointment is for a two-year term. Amendment seconded by Councilor Hooker and carried by the following vote: The motion as amended carried by the following vote: Ayes: Mayor Barham, Councilors Ward, Dotson, Ingle, Smith, Hooker, and Hoover. Nays: None - - - - - - - - Item 7c – Ordinance No. 13-2014 ORDINANCE NO. 13-2014 Ordinance Appropriating $399,293 from the Texas Department of Transportation in Federal Transit Agency Funds for FY 2014 Section 5339 Bus and Bus Facilities Formula Grants and Authorizing the City Manager to Execute All Necessary Funding Agreements Related Hereto Moved by Councilor Hoover that Ordinance No. 13-2014 be passed. Motion seconded by Councilor Dotson and carried by the following vote: Ayes: Mayor Barham, Councilors Ward, Dotson, Ingle, Smith, Hooker, and Hoover. Nays: None - - - - - - - - CITY COUNCIL MINUTES April 1, 2014 Page 5 Item 7d – Ordinance No. 14-2014 ORDINANCE NO. 14-2014 Ordinance Appropriating $5,000 to the Special Revenue Fund for Additional Grant Revenue from the State of Texas for the Texas Department of Transportation Selective Traffic Enforcement Program (“STEP” or “Click It or Ticket”) Wave Grant for Fiscal Year 2014 and Authorizing the City Manager to Accept Said Funds Moved by Councilor Hooker that Ordinance No. 14-2014 be passed. Motion seconded by Councilor Smith and carried by the following vote: Ayes: Mayor Barham, Councilors Ward, Dotson, Ingle, Smith, Hooker, and Hoover. Nays: None - - - - - - - - Item 8a – Resolution #40-2014 RESOLUTION NO. 40-2014 Resolution Authorizing the Purchase of an LED Video Display Scoreboard and Hoist System (including Installation) through the Buyboard Purchasing Cooperative from Daktronics, Inc. in the amount of $820,357.33 Moved by Councilor Smith that Resolution No. 29-2014 be passed. Motion seconded by Councilor Ingle and carried by the following vote: Ayes: Mayor Barham, Councilors Ward, Dotson, Ingle, Smith, Hooker, and Hoover. Nays: None - - - - - - - - Item 8b – Resolution #41-2014 RESOLUTION NO. 41-2014 Resolution Authorizing the City Manager to Enter into a Consultant Services Agreement with MuniServices, LLC to Conduct Sales Tax Compliance Reviews Moved by Councilor Dotson that Resolution No. 41-2014 be passed. Motion seconded by Councilor Ingle and carried by the following vote: Ayes: Mayor Barham, Councilors Ward, Dotson, Ingle, Smith, Hooker, and Hoover. Nays: None - - - - - - - - CITY COUNCIL MINUTES April 1, 2014 Page 6 Item 9a – Staff Council Discussion There were no staff reports. - - - - - - - - Item 9b – Discussion of Items of Concern to Members of the City Council Members of the City Council presented the following matters: Councilor Smith said he attended the Meals on Wheels activity last week. He noted there were 370,782 meals served during their last fiscal year; 62 percent of the clients said they would have a shortage of food without this service. Eighty-five percent said they would not have a daily hot meal without the program. Councilor Ingle asked about the status of the TCEQ test reports. Russell Schreiber said the reports were delivered and they are reviewing them. Councilor Ingle also noted the reduction in water usage for the calendar year, complimenting the citizens in the 40 percent reduction in use. He also said he would like to see the city look at citizen incentives for water reuse and reclamation for the future. He also asked about building code issues. Kevin Hugman said the ad hoc committee has met and is doing research on several matters. Councilor Ward said she appreciates what the council does to try to make the city better. Councilor Dotson thanked Mr. Burrus and his staff for the recent event at the new airport terminals as well as for getting the grant money for the airport. Mayor Barham thanked the police and fire department for their recent efforts in putting out a fire. He also stated that Glenn Beavers, who was recently involved in an aircraft accident, wrote to thank the staff for their help during and after the incident. - - - - - - - Item 10 – Executive Session City Council went into Executive Session at 10:17 a.m. in accordance with Texas Government Code §551.071, §551.072, and §551.087.
