Resolution authorizing City Staff to execute daily delivery contracts
with Proclean Team, Inc. d/b/a Green Touch Lawn and Landscape to
provide alternative sources of water to Castaway Cove Water Park
and other City facilities
WHEREAS, Stage 5 Drought Restrictions are expected to be implemented by
early Summer 2014 and will prohibit filling of outdoor public and private swimming pools
with potable water from the City of Wichita Falls;
WHEREAS, Castaway Cove has secured a contractor who can provide an
alternative source of water for public swimming pools that meets requirements set by
the Texas Department of State Health Services and the Wichita County-Wichita Falls
Health District;
WHEREAS, the City will ensure that all wells that provide water for City pools
have been tested and meet requirements set by the Texas Department of State Health
Services and the Wichita County-Wichita Falls Health District; and
WHEREAS, the City Council finds that the proposed procurements pursuant to
this resolution are exempt from the requirements of Texas Local Government Code §
252.022(a) because they are:
(1) made because of a public calamity (e.g., severe drought and depletion of
City’s reservoirs) that requires the immediate appropriation of money to relieve
the necessity of the municipality's residents or to preserve the property (e.g.,
water, pumping equipment, slides, and value attributable to ongoing-concern and
other goodwill) of the municipality;
(2) necessary to preserve or protect the public health or safety of the
municipality's residents;
(3) necessary because of unforeseen damage to public machinery, equipment, or
other property (e.g., loss of water in reservoir);
(5) for work that is performed and paid for by the day as the work progresses.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
City Staff is authorized to execute daily delivery contracts, in a form to be
approved by the City Attorney, with Proclean Team, Inc. d/b/a Green Touch Lawn
and Landscape in the amount of $600 per day for three 3,000-gallon loads of well
water per day, with adjustments to be made for days with additional or reduced loads at
the rate of $200 per load, for use in the Castaway Cove Water Park and other City
facilities.
