ORDINANCE AMENDING CHAPTER EIGHT, ARTICLE II,
SECTION 8-22 OF THE CODE OF ORDINANCES
REGULATING THE FEES FOR SOLICITORS AND
ITINERANT MERCHANTS, PROVIDING AN EXEMPTION
FOR NON PROFIT ORGANIZATIONS AND DECLARING AN
EMERGENCY.
WHEREAS, Section 8-22 of the Code of Ordinances, as amended
by Ordinance No. 136-88, provides that each applicant for a
permit shall be charged a fee of $15.00, and itinerant merchants
having more than one location shall be charged a fee of $15. 00
for each location; and,
WHEREAS, the revenue derived from the sale of goods by
organizations designated as non-profit organizations under
Section 501(c) 3 of the Internal Revenue Code is used for the
purposes of instilling in the members of such organizations
characteristics of good citizenship which will make them better
members of our community, state and nation; and,
WHEREAS, there is a desire to exempt all non-profit 501(c)3
organizations from the payment of a $15. 00 fee for each
additional itinerant merchant location.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WICHITA FALLS, TEXAS, THAT:
The provisions of Section 8-22 of the Code of Ordinances
shall be amended to read as follows:
"Section 8-22. Fees for and term of permit.
Each applicant for a solicitor or itinerant merchant permit
shall be charged a fee of Fifteen Dollars ( $15. 00) , regardless of
the term of the permit. Itinerant merchants having more than one
. location shall be charged a fee of Fifteen Dollars ( $15. 00) for
each additional location. If the applicant is other than an
individual, the applicant will be charged an additional fee of
One Dollar ( $1. 00) for each employee working as a solicitor or
itinerant merchant under the permit. All permits shall expire on
December 31 of the calendar year in which it was issued.
Non-profit organizations which have been declared as tax
exempt under Internal Revenue Code Section 501c( 3 ) shall be
charged an application fee of Fifteen Dollars ( $15. 00) and shall
be exempt from all other charges under this section. Such non-
profit organizations shall further be exempt from the
requirements of Section 8-19(c) , (d) and Section 8-24 of this
Article. "
Section 8-28(b) is hereby repealed in its entirety.
The fact that this ordinance is essential for the immediate
use of the City of Wichita Falls creates an emergency, therefore,
this ordinance shall become effective immediately upon its
passage.
