AN ORDINANCE AMENDING ORDINANCE NO. 126-84 TO
SPECIFY SIGNAGE AT DESIGNATED HANDICAP PARKING
IN PRIVATE PARKING LOTS, REQUIRING PLACEMENT AND
MAINTENANCE OF SUCH SIGNAGE AND PROVIDING FOR
PENALTY.
WHEREAS, the enforcement of Texas disabled parking laws is
essential to the protection and convenience of disabled citizens,
and
WHEREAS, it is important that signs which identify parking
areas for the disabled are clearly identified and properly
maintained,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. Subsection (f) of Section 1 of Ordinance No. 126-84
is amended to read as follows:
" (f) A parking space or area designated for the disabled is
one which is marked and designed as follows:
( 1) A designated handicap parking space shall meet the design
standards set forth in Section 6225-B of Ordinance 38-85
and shall be marked by a vertical sign bearing a white
international wheelchair emblem on a field of blue. Such
sign shall be permanently affixed at a height not less
than four ( 4) feet and not more than six ( 6) feet above
the adjacent grade and located at the immediate front of
the designated parking space. The sign shall be not less
than one hundred forty four ( 144) square inches in area
and be made of weatherproof materials.
( 2 ) Where more than two ( 2) designated handicap parking spaces
are located adjacent to each other, the intermediate
locations may be marked by signage as noted in Paragraph
(1) or may be designated by signage as noted in Paragraph
( 1) located at each end space. Where signage is located
only at each end space, the signage shall include an arrow
pointing in the direction of the intermediate parking
spaces.
( 3 ) Curbs, wheel stops, and applied striping within each
designated handicap parking space shall be painted blue.
(4) Where provided, international wheelchair symbols applied
to parking surfaces shall be white in color. "
SECTION 2. Subsection (h) of Section 1 of Ordinance No. 126-84
is amended to read as follows:

" (h) Any person, firm, or corporation commits an offense if he
fails to post the appropriate signage for designated
handicap parking required in parking lots under his
control. "
SECTION 3. Section 1 of Ordinance No. 126-84 is amended by
adding Subsections ( i) , ( j ) and (k) , to read as follows:
" (i) Any person, firm, or corporation commits an offense if he
fails to maintain the appropriate signage for designated
handicap parking required in parking lots under his
control.
( j ) A person commits an offense if the person causes damage to
or removes signage from designated handicap parking
locations.
(k) An offense committed under this section shall be a Class C
misdemeanor and shall be punishable by a fine not to
exceed $200.00. Each day that the violation exists shall
constitute a separate offense. "
