ORDINANCE AMENDING CHAPTER 12 OF THE CODE OF ORDINANCES OF
THE CITY OF WICHITA FALLS, TEXAS, PERTAINING TO THE
MUNICIPAL COURT, AS PART OF THE CITY COUNCIL'S EFFORT TO
UPDATE OBSOLETE SECTIONS OF THE CODE OF ORDINANCES
WHEREAS, the City Council of the City of Wichita Falls,
Texas, has directed the City staff to update obsolete sections of
the Code of Ordinances; and,
WHEREAS, certain sections of Chapter 12 of the Code of
Ordinances pertaining to the Wichita Falls Municipal Court have
been made obsolete by the special state law establishing the
Wichita Falls Municipal Court of Record, and other state laws.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WICHITA FALLS, TEXAS, THAT:
Chapter 12 of the Code of Ordinances of the City of Wichita
Falls, Texas, is amended in its entirety to read as follows:
"Municipal Court of Record
Sec. 12-1 . Applicability. This chapter applies to the
municipal court of record created by Ordinance 2533 , passed
September 16, 1969.
Sec. 12-2. Fees and court costs.
In addition to collection of all fees and court costs
authorized by state law, the municipal court shall assess and
collect a Ten ($10.00) Dollar administration fee from each person
taking a driving safety course for the purpose of dismissing a
traffic citation.
Sec. 12-3 . Discharge of fine and costs through community
service.
(a) When a defendant is convicted in municipal court
of a misdemeanor and his punishment is assessed at a pecuniary
fine and costs, as an alternative to the other methods of
discharging such fine and costs, he may, at his option and if
acceptable to the municipal judge, discharge such fine and costs
by contracting with the City to perform certain services. If he
chooses this option, he shall be directed to report to the court
clerk, who shall administer this program.
(b) The defendant shall contract to perform such
services as an independent contractor, and shall be credited for
compensation at the basic hourly rate for which the City pays
employees performing the same or similar services.
(c) When the defendant has completed, in an acceptable
manner, such services to the extent that the compensation
credited to him equals the amount of such fine and costs, such
fine and costs shall be discharged and satisfied. If the
defendant fails to complete such services in an acceptable manner
by the completion date, he shall be given credit at the hourly
rate for the hours performed under the contract, and shall be
required to discharge the balance of his fine and costs as
required by law.
Sec. 12-4. City marshals.
(a) Appointment and qualifications. City marshals
shall be appointed and removed by the city manager of the City of
Wichita Falls, and they shall have such qualifications as set
forth under state law.
(b) Duties. The principal duties of city marshals
shall be the serving of the warrants and processes of the
municipal court.
(c) Supervision; salary. City marshals shall work
under the direction of the municipal court clerk, and their
salaries shall be budgeted in the municipal court budget under
the title of city marshal. "
