AN ORDINANCE CLOSING, VACATING, AND ABANDONING A TWENTY-FIVE
( 25) FOOT WIDE EAST-WEST ALLEY IN BLOCK 92, ORIGINAL
TOWNSITE, WICHITA FALLS, TEXAS, AND RETAINING A UTILITY
EASEMENT
WHEREAS, the Planning and Zoning Commission has recommended
the closure of a twenty-five foot wide alley in Block 92, Original
Townsite, Wichita Falls, Texas, subject to the retention of a
utility easement; and,
WHEREAS, the City Council of the City of Wichita Falls, Texas
deems it advisable and in the public interest to close, vacate and
abandon the alley hereafter described.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. A twenty-five ( 25) foot wide east-west alley lying
in Block 92, Original Townsite, Wichita Falls, Texas; and bounded
to the east by the westerly right-of-way of Indiana Avenue, to the
west by the easterly right-of-way of Scott Avenue, to the north by
the southerly lot line of Lot 9-B, Block 92, Original Townsite,
and to the south by the northerly lot line of Lot 1-A, Block 92,
Original Townsite;
be and the same is hereby closed, vacated, and abandoned.
SECTION 2. A ten ( 10) foot wide utility easement over an
existing 15" sewer line, whose centerline intersects with the
above described alley at a distance of 89. 5 feet from the south-
east corner of Lot 9-B and 125 feet from the northeast corner of
Lot 1-A, more or less, of Block 92, Original Townsite, is hereby
retained as a drainage and utility easement, for the purposes of
laying and maintaining all kinds and character of utility lines,
including water, gas, electric, telephone, T.V. cable, power
lines, and sanitary and storm sewers.
