Resolution selecting Geograph Industries, Inc. as the offeror that has
submitted the best value for the City in its proposal for the Exterior
Signage Project, and authorizing the City Manager to negotiate and
execute a contract with said offeror in a total amount that shall not
exceed $1,089,473
WHEREAS, the City of Wichita Falls properly advertised and requested
proposals for the purchase, fabrication and installation of Exterior Signage (Wayfinding
signage project);
WHEREAS, the City evaluated bids based on “best value,” utilizing the following
criteria: price, reputation of the offeror, reputation of the offeror’s goods & services,
extent to which the proposal’s goods & services met the City’s needs, and the total long
term cost to the City to acquire the proposed goods & services;
WHEREAS, the City Council finds that this bidding process complied with
Chapter 252 of the Texas Local Government Code and further finds that this bidding
process was not required to comply with Chapter 252 of the Texas Local Government
Code because this purchase is a procurement necessary to preserve or protect the
public health and safety of the City’s residents pursuant to Tex. Local Gov’t Code
§252.022(a)(2);
WHEREAS, the City Council finds that the procurement of these goods and
services complies with all terms of Texas Local Government Code § 252.021,
Subchapter C of the Chapter 252 of the Texas Local Government Code and Subchapter
D of Texas Gov’t Code, to the extent any of said sections and subchapters apply to this
transaction;
WHEREAS, the City Council finds that the evaluation, ranking, and selection of
these proposals complies with all provisions of Texas Local Gov’t Code § 252.042, and
Texas Gov’t Code § 2269.154, and Geograph Industries, Inc. is the offeror that has
submitted the proposal providing the best value for the City; and
WHEREAS, the City Council finds that the City is permitted to negotiate with
Geograph Industries, Inc. because (1) Chapter 252 does not apply to the bidding
requirements herein, (2) the City procedures are in compliance with Texas Local Gov’t
Code § 252.042 to the extent said section applies, and (3) the City procedures are in
compliance with Texas Gov’t Code § 2269.154 to the extent said section applies.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
Geograph Industries, Inc. is selected as the offeror that has submitted the best
value for the City in its proposal for the Exterior Signage Project, and the City Manager
is authorized to negotiate and execute a contract with said offeror in a total amount that
shall not exceed $1,089,473.
