4 AN ORDINANCE AMENDING CERTAIN SECTIONS
5 OF THE ZONING ORDINANCE OF THE CITY OF WICHITA FALLS, TEXAS

7 WHEREAS, the Planning & Zoning Commission has conducted a
8 public hearing and has made recommendations to amend certain
9 sections of the Zoning Ordinance of the City of Wichita Falls,
10 Texas; and,
11
12 WHEREAS, the City Council of the City of Wichita Falls,
13 Texas deems that the proposed zoning amendments hereafter
14 described are in accordance with the Comprehensive Land Use Plan,
15 and in the public interest.

17 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
18 CITY OF WICHITA FALLS, TEXAS, THAT:

22 Section 2000 of the Zoning Ordinance, Ordinance 38-85 is hereby
23 amended to read as follows with deleted language shown as

30 The purpose of this section is to define the terms used in this

34 section, except where the context of such words or phrases
35 clearly indicates a different meaning or construction. Sections

38 2020 GENERAL CONSTRUCTION OF LANGUAGE

40 The following general construction of language shall apply to
41 the textual provisions of this ordinance:

43 Conjunctions. The following conjunctions shall be interpreted as
44 follows:

46 A. "And" indicates that all connected items or provisions
47 apply.

49 B. "Or" indicates that the connected items or provisions
50 may apply singly or in any combination.

52 C. "Either or" indicates that the connected items or
53 provisions shall apply singly but not in combination.

Definitions
1 Illustrations. In case of any difference of meaning or
2 implication between the text of any provision and any
3 illustration, the text shall control.

5 Person. The word person includes a firm, association,
6 organization, partnership, trust, company, or corporation as well
7 as an individual.

9 Shall & May. The word shall is mandatory, and the word may is
10 discretionary.

12 Tenses & Numbers. Words used in the present tense include the
13 future tense, and the singular number includes the plural, and
14 the plural number includes the singular, unless the text clearly

27 A building for a use subordinate in area, extent, or purpose to
28 the use of the principal building. Such a use is customarily
29 found in connection with the main building. An accessory
30 building for the storage of personal property of the occupant of
31 the principal building and not having floor area in excess of 1/2
32 that of the principal building.

16 used or intended to be used for the retail dispensing or sales of
17 vehicular fuels; and including as an accessory use the sale and
18 installation of lubricants, tire, batteries, and similar

21 AUTOMOTIVE REPAIR SERVICES
22 Repair of automobiles, noncommercial trucks, motorcycles,
23 motorhomes, recreational vehicles, or boats including wheel and
24 brake shops, body and fender shops, and similar repair and

27 AWNING
28 A roof-like cover, temporary in nature, extending from the wall
29 of the building/structure, over an area to provide shade and/or
30 shelter. The awning shall be entirely supported by the exterior

7 BUFFER AREAS
8 A strip of land identified on a site plan or by zoning ordinance,
9 established to protect one type of land use from another land use
10 which is incompatible. Buffer zones may be zoned or shown on a
11 site plan. Normally, a buffer zone is landscaped and kept in
12 open space uses.

14 BUFFERING
15 Separating one use from another to shield or block noise, lights,
16 or other nuisances.

18 BUILDING
19 Any structure designed, built, or intended for the shelter or
20 enclosure of persons, animals, chattels, or movable property of
21 any kind, or for an accessory use. When separated by an absolute
22 fire separation, each portion of such structure so separated
23 shall be deemed a separate building. This definition shall
24 include the structures wholly or partly enclosed with an exterior
25 wall.

27 BUILDING LINE
28 A line parallel or approximately parallel to the street line at
29 specified distance from there, marking the minimum distance from
30 the street line that a building may be erected. For existing
31 buildings, the building line shall be the exterior wall or
32 omitted wall line which is closest to the street (See Section
33 4200) .

35 BUILDING OFFICIAL
36 The Building Official of the City of Wichita Falls, Texas.

38 BUS STATION
39 Any premises for the transient housing or parking of motor driven
40 buses and the unloading and loading of passengers.

2 A place dedicated to and used and intended to be used for the

7 A line erected midway between the bounding right-of-way lines of
8 street or alley. Where the bounding right-of-way lines are

5 The purpose of the PUD Planned Unit Development district is to
6 provide flexibility in site planning and allow the departure from
7 the strict development regulations. The site must be planned and
8 developed as a unit with a high quality of design. Industrial
9 parks, shopping centers, residential developments of multiple or
10 mixed housing, or appropriate combinations thereof for
11 specialized purposes would be suitable.

13 3660 APPROVAL PROCESS

15 The approval process for a PUD district shall be the same as the
16 Amendment Procedures in Section 7500. The City Council's approval
17 of a PUD shall be by amendment to the Zoning Ordinance. Such
18 amendment shall designate the boundaries of the district and
19 include such conditions which in the judgment of the City Council
20 are necessary to secure the health, safety, and general welfare
21 of the community.

23 3670 SUBMISSION REQUIREMENTS

25 A. PROJECT DESCRIPTION: The applicant shall submit a clear
26 and concise report containing the following information:

28 1. A general description of the project.
29 2. A statement of design objectives of the PUD.
30 3 . Total project acreage, the acreage associated with
31 each use, the number of residential units, the square
32 footage of non-residential uses, projected number of
33 employees and projected peak customer visits, if
34 applicable.
35 4 . A proposed timetable or phasing of the project.

37 B. SITE PLAN: The applicant shall submit a site plan which
38 shall include the following information:

40 1. The location of all proposed uses including buffer
41 areas.
42 2 . The outlines and square footages of all structures.

45 affected by the PUD.

3 The following criteria shall be used to review a PUD, or to
4 establish any special condition of approval:

6 1. The proposal shall be in conformance with the land use plan
7 and all other plans and policies adopted by the City of

10 development patterns which would occur under existing zoning

11 development to the lots abutting Brook Avenue.

29 When additions or enlargements are made to an existing
30 building or use, or any change of occupancy or manner of
31 operation is made that would result in additional parking
32 spaces being required, off-street parking shall be provided
33 on-site for the entire building or use.
34
35 Furthermore, there shall be no parking of vehicles in
36 the setback area abutting any street except for Brook Avenue.
37 Additionally, there shall be no parking of vehicles on the
38 street curb in this district, unless the curb abuts a single-
39 family or duplex residential use.

41 11. Access: Parking facilities for non single-family and
42 duplex residential-uses dwellings may have no more
43 than one (1) curb-cut per lot, and may also be
44 allowed ingress and egress from an alley.
45
46 12 . Landscaping: Landscaping shall be provided in
47 accordance with Section 6830 of this ordinance.
48 Furthermore, the setback area abutting any street
49 except for Brook Avenue shall be landscaped with
50 grass or any other similar ground cover, and shall
51 not be paved with any impervious material except for
52 required driveway.

1 3844 BUFFERING REQUIREMENTS

3 Due to the special character of the BA district, the following
4 buffering requirements shall apply in lieu of the requirements of
5 Section 4600:

10 residential abut a SF-2 district, no portion of the structure
11 shall be closer to the SF-2 district than 30 feet. This

27 shall extend from the building setback line to the property
28 line.

12 nonconforming regulations shall apply in lieu of the requirements
13 of Section 6100 of this ordinance. A nonconforming use in a BA
14 district shall not be resumed if discontinued for a period
15 exceeding six (6) months; expanded; converted to a different
16 nonconforming use; or reconstructed if destroyed. Existing
17 office uses may be converted to another office if minimum parking
18 requirements are met. A nonconforming sign shall be removed after
19 discontinuance of a nonconforming use. "

13 A. Cornices, window sills, flues and chimneys, and eaves may
14 project two (2) feet into the required setback area.

16 B. Fences may project into the front, side and rear setback
17 areas on all properties except those with single-family and
18 duplex residential uses. In properties with single-family
19 and duplex residential uses, fences may project into the
20 side and rear setback areas; fences may project into the
21 front setback areas if they meet all of the following
22 criteria:

24 1. the fence shall have at least fifty percent (50%) of
25 the face area open and free of opaque materials;
26
27 2 . the fence shall be no more than four (4) feet tall;
28
29 3 . the fence shall not totally enclose all or a part of
30 the front setback area if the front door of the
31 residence opens into the enclosed area, unless a Postal
32 Service approved mailbox is provided outside the
33 enclosure;

35 4 . if the fence is located near a street intersection, it
36 shall conform to Chapter 29, Section 214 (g) of the
37 Wichita Falls Code of Ordinances, as amended,
38 concerning view obstruction.

40 C. Uncovered steps, porches, or patios which are no more than 2
41 feet above the adjacent grade may be placed within the
42 required setback area.
43
44 D. Uncovered swimming pools, hot tubs and satellite dish
45 antennas may be placed in the rear or interior side setback
46 areas.
47
48 E. Accessory buildings not exceeding 150 sq. ft. in floor area
49 may be placed within the rear setback area, but no closer
50 than one foot from the rear lot line.

52 F. Gasoline pump islands may be placed in the front and
53 exterior side setback area, provided that they are placed no
54 closer than 12 feet from the property line. Canopies

1 attached to the pump islands shall provide at least 14 feet
2 of clearance from the ground to the bottom of the canopy,

22 HI, RDD, and CBD zones and also authorized subject to the
23 approval of the City Council in all other zones.

25 5430 SALES NEAR CHURCHES, HOSPITALS AND SCHOOLS
26
27 A. The sale of alcoholic beverages within the city by any
28 dealer whose place of business is within three hundred (300) feet
29 of a church or hospital, the measurements to be along the
30 property lines of the street fronts and from front door to front
31 door, and in a direct line across intersections, is hereby
32 prohibited. This section shall not apply to Temporary Sales
33 authorized under Section 5420, subsection 5.
34
35 B. The sale of alcoholic beverages within the city by any
36 dealer whose place of business is within three hundred (300) feet
37 of a school is hereby prohibited. The measurements of the
38 distance between the place of business where alcoholic beverages
39 are sold and the school shall be from the nearest property line
40 of the school to the nearest doorway by which the public may
41 enter the place of business, along street lines and in direct
42 line across intersections. For any permit or license covering a
43 premise where minors are prohibited from entering the premise
44 under Section 109.53 of the Alcoholic Beverage Code, the
45 measurement of the distance between the premise and a school
46 shall be along the property lines of the street fronts and from
47 front door to front door, and in a direct line across
48 intersections. This section shall not apply to Temporary Sales
49 authorized under Section 5420, subsection 5. "

6 "6200 OFF-STREET PARKING, LOADING AND CURB-CUT REGULATIONS
7
8 6205 PURPOSE
9 Sections 6200 through 6299 shall be known as the Off-Street
10 Parking, Loading, and Curb-Cut Regulations. The regulations
11 require provisions for off-street parking and loading facilities
12 proportional to the need created by each use in order to ensure
13 functionally adequate, secure off-street parking and loading
14 facilities and to limit the number of curb cuts along major
15 streets to an amount conducive to reasonable safety standards.
16 Development regulations and design standards are intended to
17 ensure the usefulness of the parking and loading facilities,to
18 protect public safety, and, where appropriate, to mitigate
19 potentially adverse impacts on adjacent land uses.
20
21 6210 BASIC PROVISIONS
22
23 A. Off-street parking facilities, loading facilities, and
24 the prescribed number of curb cuts shall be provided for any new
25 building constructed, for any new use established, and for any
26 addition or enlargement of an existing building or use, or any
27 change of occupancy or manner of operation that would result in
28 additional parking spaces being required unless specifically_
29 exempted by this ordinance. The additional parking shall be
30 required only for such addition, enlargement, or change and not
31 for the entire building or use.
32
33 B. Minor variations of parking lot design, or standards
34 may be approved by the Director of Planning, as long as the
35 purpose of this section is met.
36
37 C. All required parking facilities shall be maintained
38 for the duration of the use requiring such areas. Such
39 facilities shall be used exclusively for the temporary parking
40 of motor vehicles. Parking facilities shall not be used for the
41 sale, display, or storage of merchandise, or for the storage or
42 repair of vehicles or equipment.
43
44 D. All required parking facilities, loading facilities,
45 and curb cuts shall be located on the same site as the use for
46 which such facilities are required, except as authorized
47 pursuant to Section 6231.
48
49 E. Head-in parking from a public street right-of-way is
50 prohibited, except for single-family or duplex residential use.
51
52 F. Each parking space shall have adequate drives, aisles,
53 and turning and maneuvering areas for access and usability, as
54 per the requirements of this ordinance, and shall at all times

1 have access to a public street or alley. No off-street parking
2 facility shall be located either in whole or in part in a public
3 street or alley right-of-way or obstruct any public sidewalk.

5 G. Vehicular alley access for ingress and egress to off-

7 resdentiaf-uses shall be permitted, except when screening is
8 required along the alley under the provisions of Section 4620.

10 H. When vehicle access is taken directly from the alley, the
11 garage or carport shall be setback at least 29 5 feet from the
12 edge of the alley pavement.

14 I. Every parking space shall be striped or marked by a
15 concrete, wood, or similar material wheel stop. Additional safety_
16 features shall be provided as per Section 6232 of this ordinance.

26 shall be specifically designed, located, and reserved for
27 vehicles licensed by the State for use by the handicapped. These

1 B. Design standards for handicapped parking facilities:

3 Each parking space designated for use by the handicapped
4 shall consist of a rectangular area not less than 3R 75 8 feet
5 wide with a 5 feet wide clear space which may be shared by
6 another handicapped space, by 18 75 19 feet long, with a vertical
7 clearance of 7.5 feet, shall be located in an area not exceeding
8 a 2 percent slope, and shall be located near and convenient to a
9 level or ramped entrance accessible to handicapped persons.
10 Parking spaces for the handicapped shall be signed and
11 restricted for use by the handicapped only, as required bv_
12 Ordinance No. 13-89, as amended.

16 6231 MIXED USE & OFF-SITE PARKING

18 A. The Planning Department may approve locating a portion
19 of the required parking on another site when both the primary use
20 and parking facility are located in a similar zone.

22 B. Off-site parking shall be located within 300 feet of
23 the use which it serves, Measured-frets-the-preperty-Iine7
24 measured as the shortest practical walking distance from the
25 nearest off-site parking space to the nearest entrance to the
26 building or use which it serves.

28 C. The off-site parking approval shall require the written
29 agreement of the owner of the off-site parking area to assure
30 the continued availability of the required parking area.

32 D. Off-site parking facilities shall not fulfill more
33 than 50 percent of a use's parking requirement.

35 E. Handicapped parking spaces shall not be located in an
36 off-site parking area.

38 F. The Planning and Zoning Commission may authorize an
39 adjustment in the total parking requirements for mixed use
40 developments if the facilities have substantially different peak
41 demand hours for parking. A request for adjustment shall require
42 the submission of a site plan and traffic study which address
43 the rationale for reducing parking requirements.

45 6232 SAFETY FEATURES

47 Parking facilities shall meet the following safety standards:

49 A. Safety barriers, wheel stops, protective bumpers or
50 curbing shall be provided to prevent encroachment onto adjoining
51 public or private property.

53 B. Visibility of and between pedestrians, bicyclists, and
54 motorists shall be assured when entering individual parking

2 entering and exiting a parking facility.

4 C. Internal circulation patterns, and the location and
5 traffic direction of all access drives, shall be designed and

13 shall, to the maximum extent feasible, be designed to reflect
14 away from any residential use.

28 Areas used for primary circulation, for frequent idling of
29 vehicle engines, or for loading activities shall be designed and
30 locate to minimize impacts on adjoining properties, including
31 provision for screening or sound reduction.

33 6236 MAINTENANCE

35 All parking and loading facilities shall be maintained to
36 assure desirability and usefulness of the facility. Such
37 facilities shall be maintained free of refuse, debris, or
38 other accumulated matter and shall at all times be available for
39 the off-street parking or loading use for which they are required
40 or intended.

42 6237 DRAINAGE

44 All parking facilities shall be graded and provided with
45 permanent storm drainage facilities, meeting the construction
46 specifications set by the Public Works Department. Surfacing,
47 curbing, and drainage improvements shall be sufficient to
48 preclude the free flow of water onto adjacent properties or
49 public streets or alleys, and to provide adequate drainage.

1 6238 LANDSCAPING

3 Retail trade, shopping centers, and indoor entertainment uses
4 which have more than 20, 000 sq. ft. in g. f.a. shall provide
5 landscaping in addition to the requirements of Section 6800 in
6 the following manner:

8 A ten (10) feet wide unpaved area shall be retained abutting
9 the property lines on the sides adiacent to a street right-
10 of-way. This area shall be landscaped by at least ground
11 cover along with the landscape trees required by Section
12 6800, and,
13
14 Within the parking area, a six (6) feet tall tree shall be
15 planted in a manner to limit unbroken rows of parking to a
16 maximum length of one hundred (100) feet. No paving shall be
17 allowed within three (3) feet of such tree(s) .

19 The Planning & Zoning Commission may approve an alternate
20 landscaping plan upon finding that such alternate plan meets the
21 intent of the landscaping requirements of this section
22
23 The landscaping regulations in this section shall be irrigated
24 and maintained as per the Landscaping Regulations in Section
25 6800.

5 In any district other than CBD, for every building or part
6 thereof hereafter erected with a minimum gross floor area of
7 twelve thousand (12, 000) sq. ft. , which is to be occupied by
8 manufacturing, storage, warehouse, goods display, retail store,
9 wholesale store, market, hotel, hospital, mortuary, laundry, dry
10 cleaning or other uses similarly requiring the receipt or
11 distribution of vehicles of material or merchandise, there shall
12 be provided and maintained on the same lot with such building,
13 at least one (1) off-street loading space, plus one (1)
14 additional such loading space for each additional twenty
15 thousand (20, 000) sq. ft. , or major fraction thereof.
