ORDINANCE GRANTING AUTHORITY TO THE FIRST
UNITED METHODIST CHURCH TO CONSTRUCT A CANOPY
FROM ITS CENTER ENTRANCE ON TRAVIS STREET,
WHICH EXTENDS ACROSS THE PROPERTY LINE.
WHEREAS, First United Methodist Church, which is located at
909 Tenth Street, at the intersection of Tenth and Travis
Streets, has requested permission to construct a canopy which
covers the sidewalk from the center entrance to the church on
Travis Street, and which will extend across the property line;
and,
WHEREAS, Section 2201. 2 of the Building Code provides that
canopies which extend over the sidewalk shall be entirely
supported from the building, and shall not extend more than two-
thirds of the width of the sidewalk measured from the building;
and,
WHEREAS, the City Council finds that the circumstances
involved are exceptional, and that such authority should be
granted.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. First United Methodist Church is hereby granted
the right and authority to construct a canopy from the center
Travis Street entrance to the building out to the curb line,
supported by posts; such canopy shall be constructed in
accordance with the plans and specifications which have been
approved by the Director of Public Works and the Building Code
Administrator.
SECTION 2. Such church shall coordinate such project with
all utility companies whose facilities are located in the Travis
Street right-of-way.
SECTION 3 . It shall be the responsibility of the church at
all times to maintain said canopy at its own expense. If at any
time in the future some public use of such right-of-way makes it
necessary that the canopy be relocated or removed, such
relocation or removal shall be done at the sole cost and expense
of the church.
SECTION 4. Whenever any work is being done on the
construction or maintenance of said canopy, the church shall take
all necessary and proper precautions to protect the public from
damages. The church shall hold and save the City of Wichita
Falls harmless from all damages or claims for damages resulting
from the construction, maintenance and location of such canopy.
SECTION 5. The right and authority hereby granted is for so
long as said canopy is used and maintained by said church,
subject to the provisions of Section 3 hereof. When the canopy
is no longer so used, it shall be removed by the church at its
sole cost and expense.
