ORDINANCE EXTENDING THE PERIOD WITHIN WHICH
AMERICAN TELEVISION AND COMMUNICATIONS
CORPORATION SHALL FILE WITH THE CITY CLERK
ACCEPTANCE OF FRANCHISE AMENDMENT PURSUANT TO
ORDINANCE NO. 78-88, SECTION FOUR.
WHEREAS, on the 21st day of June, 1988, the City Council of
the City of Wichita Falls passed Ordinance No. 78-88, thereby
amending Ordinance No. 3305, known as the "Wichita Falls Cable
Television Ordinance" ; and,
WHEREAS, Section Four of said ordinance extended the term of
the "Wichita Falls Cable Television Ordinance" for an additional
year to April 3 , 1994, provided that within fifteen ( 15) days
after the date of passage American Television and Communications
Corporation shall file with the City Clerk its unconditional
acceptance of the franchise amendment; and,
WHEREAS, American Television and Communications Corporation,
through oversight, failed to file said acceptance as required,
but in fact did accept the rights, duties and obligations
required thereunder; and,
WHEREAS, extension of the period of acceptance to June 21,
1989, will allow American Television and Communications
Corporation to file the required acceptance, ratifying all
actions from June 21, 1988 to present and thereby avoiding for
all parties any uncertainty regarding the viability of Ordinance
No. 78-88 .
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WICHITA FALLS, TEXAS, THAT:
The period within which American Television and
Communications Corporation shall file with the City Clerk its
unconditional acceptance of Ordinance No. 78-88, an amendment to
the "Wichita Falls Cable Television Ordinance" , is hereby
extended to June 21, 1989.
