AN ORDINANCE CLOSING, VACATING, AND ABANDONING A 25 FOOT
WIDE ALLEY IN BLOCK 211 , ORIGINAL TOWNSITE, WICHITA FALLS,
TEXAS, AND RETAINING A UTILITY EASEMENT
WHEREAS, Gibson Products Company, Inc. has requested
permission to fence an alley at their downtown store for
security purposes; and,
WHEREAS, the closing of such alley may be permitted with
the retention of a utility easement and guaranteed access to
public and private utility companies; and,
WHEREAS, the City Council deems that the closing of the
alley described is in the public interest.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. The twenty-five ( 25) foot wide alley in Block
211, Original Townsite, is hereby closed, vacated, and
abandoned.
SECTION 2. The City of Wichita Falls hereby reserves a
utility easement for the purpose of laying and maintaining all
kind and character of utility lines, including water, gas,
electric, telephone, T.V. cable, power lines, and sanitary and
storm sewers in the portion of the alley right-of-way closed in
Section 1.
SECTION 3. The retained easement described in Section 2
shall have guaranteed vehicular access at all times. If fenced,
the gates shall remain open at all times when the business is
closed.
