ORDINANCE NO. 62-89
AN ORDINANCE EXTENDING THE CITY LIMITS OF THE CITY OF
WICHITA FALLS, TEXAS, BY ANNEXING A CERTAIN TRACT OF
LAND ADJACENT TO THE TERRITORIAL LIMITS OF THE CITY OF
WICHITA FALLS, TEXAS, WHICH TRACT OF LAND AND SERVICE
PLAN FOR SUCH TRACT OF LAND ARE DESCRIBED IN THIS
ORDINANCE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
WICHITA FALLS, TEXAS THAT:
SECTION 1. TRACT DESCRIPTION: The following tract of
land located in Wichita County, Texas, be and the same is hereby
ordered to be annexed and to be included within the corporate
limits of the City of Wichita Falls, Texas, and the corporate
limits be extended so as to include said tract of land in Wichita
County, Texas, the same being more specifically described as
follows:
A TRACT OF LAND out of Cherokee County School Lands, A-33 , Kemp
and Newby Subdivision Blocks 6, 7, 8, 9, 10, 11, 12, 13 , 14, 16,
17, 18, 19, and 20 and 44, the L. Lapoleum Survey, A-728, the
J.R. McDowell Survey, A-282, all in Wichita County, Texas
BEGINNING at the most Westerly Southwest corner of Tract I as
described in Wichita Falls City Ordinance No. 3746, an annexation
ordinance adopted by the Wichita Falls City Council on December
2, 1980, said corner being a corner of the Wichita Falls city
limits;
THENCE West to a point 1000 feet East of the center of Old
Windthorst Road;
THENCE South, parallel to and 1000 feet East of the center of Old
Windthorst road to a point in the South line of Block 18, Kemp
and Newby Subdivision;
THENCE East with the South line of said Block 18, a distance
equal to the East-West section of Old Windthorst Road immediately
West of this line;
THENCE South parallel to and 1000 feet East of the center of Old
Windthorst Road to a point in the South line of Block 19, Kemp
and Newby Subdivision;
THENCE East with the South line of said Block 19, a distance
equal to the East-West section of Old Windthorst Road immediately
West of this line;

THENCE South parallel to and 1000 feet East of the center of Old
Windthorst Road crossing Rathgeber Road, and continuing on South
to a point 1000 feet South of the center of Rathgeber Road;
THENCE West, parallel to and 1000 feet South of Rathgeber Road to
a point due South of the Southeast corner of Tract VII as
described in Wichita Falls City Ordinance No. 2598 , an annexation
ordinance adopted by the Wichita Falls City Council on July 7,
1970;
THENCE North to the Southeast corner of said Tract VII, being 200
feet South of the South right-of-way line of Rathgeber Road;
THENCE in a Northerly, Easterly and Southerly direction with the
current Wichita Falls city limits line, described by various city
ordinances, to the PLACE OF BEGINNING and containing
approximately 1580 acres of land, the intent of this description
being to encompass all acreage West and North of the specifically
described courses, not heretofore included in the Wichita Falls
city limits.
SECTION 2.0. SERVICE PLAN: This service plan for
annexation of property to the City of Wichita Falls, Texas, has
been prepared by the Planning Department of the City of Wichita
Falls in conformance with the requirements of Chapter 43 ,
Subchapter C, Section 43 .056, Texas Local Government Code:
SECTION 2. 1: SERVICES TO BE PROVIDED WITHIN SIXTY (60)
DAYS. A. Police Protection. Police protection personnel and
equipment from the Wichita Falls Police Department will be
provided to the area within sixty ( 60) days of the effective date
of annexation, using existing personnel and equipment.
B. Fire Protection. Fire protection and suppression
personnel and equipment from the Wichita Falls Fire Department
will be provided upon residents' requests within sixty (60) days
of the effective date of annexation using existing personnel and
equipment. Fire protection service to the tract will be as
follows: Primary service will be provided by Fire Station No. 3,
which has a response time of 6.0 minutes. Back-up service will
be provided by Station No. 4 with a response time of 6.0 minutes.
The services of the City of Wichita Falls Fire Marshall shall be
provided within the same time frame.
C. Solid Waste Collection. Solid waste collection shall
be provided by the City of Wichita Falls Sanitation Division in
accordance with Chapter 17: "Garbage, Refuse, Rubbish and
Trash," Code of Ordinances, as amended, City of Wichita Falls,
within sixty (60) days of the effective date of annexation. The
collection of refuse from individual properties and containers
shall be made in accordance with usual Sanitation Division
scheduling. The provision of refuse container receptacles shall
be determined by the Sanitation Division upon request of eligible
individual residents.

D. Maintenance of Water and Waste Water Facilities.
Maintenance of water facilities shall be assumed by the City of
Wichita Falls Public Utilities Department in accordance with
Chapter 32: "Water and Sewers," Code of Ordinances, as amended,
City of Wichita Falls, within sixty ( 60) days of the effective
date of annexation.
The initial cost of the water main extensions and provision of
fire hydrants in this tract is based on a 12" diameter water
main, of which oversizing costs will be paid by the City of
Wichita Falls. The balance of the costs associated with these
water services, plus individual line extensions, will be paid by
individual property owners through tapping fees. Prior to tying
on to the city water system, individual septic systems must be
inspected and approved by the city health department.
All existing property in the annexed area will remain on septic
tank systems. Sanitary sewer extensions will be paid by the
subdividers as additional development
occurs in accordance with
the city' s Comprehensive Subdivision Ordinance and/or Chapter 32:
"Water and Sewers," Code of Ordinances, as amended, City of
Wichita Falls.
E. Maintenance of Roads, Streets, Alleys and Street
Lighting. Existing dedicated county roads in the area will
become the maintenance responsibility of the City Wichita Falls
Public Works Department. A maintenance and improvement program
for these roadways will be initiated within sixty (60) days of
the effective date of annexation. The existing roads constructed
to county standards will be improved to city standards under the
Reconstruction Program when requested by the residents or when
required because of increased population density due to
development. Adjacent property owners will be assessed for the
cost of curb and gutter.
The placement of proper traffic control devices, street markers
and street lights shall be made within sixty (60) days of the
effective date of annexation. All traffic control devices,
street markers, and street lights shall be located per the
requirements of the Director of Traffic and Transportation.
Maintenance of existing traffic control devices, street markers,
and street lights shall become the responsibility of the City of
Wichita Falls Traffic and Transportation Department within sixty
(60) days of the effective date of annexation.
Traffic control devices, street markers, and street lights
required by additional development in the area will be provided
in accordance with Chapter 27: "Streets and Sidewalks," Code of
Ordinances, as amended, City of Wichita Falls.
F. Maintenance of Parks, Playgrounds, Swimming Pools, and
other Publicly Owned Facilities, Buildings, or Services. Since
no public parks, playgrounds, swimming pools, or other publicly
owned facilities or buildings presently exist in this tract, no

maintenance of such is necessary. Upon development of any of
these facilities and acceptance by the city, maintenance shall
become the responsibility of the City of Wichita Falls.
Residents within the annexed areas shall be afforded the
opportunity to utilize all city services including, but not
limited to, code enforcement, planning, legal, library, health,
and parks and recreation programs within sixty ( 60) days of the
effective date of annexation.
SECTION 2. 2: CAPITAL IMPROVEMENTS. All capital
improvements including, but not limited to, streets, alleys,
water service lines, waste water service lines, and fire
hydrants, for new development shall be constructed by the
developer of the tract in accordance with Appendix A
"Comprehensive Subdivision Ordinance," Code of Ordinances, as
amended, City of Wichita Falls.
SECTION 3.0: PUBLIC HEARINGS. In conformity with
Chapter 43 , Subchapter C, Section 43.052, Texas Local Government
Code, before these annexation proceedings were instituted, public
hearings were held August 1, 1989, and August 15, 1989, to
provide an opportunity for all interested persons to be heard;
these hearings were held not more than forty (40) days nor less
than twenty ( 20) days prior to the institution of these
annexation proceedings. Notices of the public hearings were
published once each in the Wichita Falls Times/Record News not
more than twenty ( 20) days nor less than ten ( 10) days prior to
each hearing.
