Ord 74-89 10/17/1989 ORDINANCE NO. 74-89 ORDINANCE AMENDING SECTION 24-22 OF THE CODE OF ORDINANCES TO PROVIDE PUBLIC DISCLOSURE OF THE FRONT PAGE OF LAW ENFORCEMENT OFFENSE REPORTS AT A COST OF ONE ( $1. 00) DOLLAR. WHEREAS, Vernon' s Ann. Civ. St. Art. 6252-17(a) , commonly known as the Texas Open Records Act, has been construed to require that the front page of Police complaint reports shall be subject to public disclosure at a cost which is not excessive; and, WHEREAS, the City Council desires to amend Section 24-22 of the Code of Ordinances to bring said provisions into compliance with state law. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: Section 24-22 of the Code of Ordinances of the City of Wichita Falls is hereby amended in its entirety to read as follows: "Sec. 24-22. Authority to furnish copies of police complaint reports; charge. (a) The Chief of Police is authorized to furnish portions of the police complaint report made by investigating officers and/or records to any person who requests such report. The portions subject to disclosure shall be those items indicating offense alleged location of alleged offense, identification and description of complainant, premises involved, time of occurrence, property involved, vehicle involved, description of weather, detailed description of offense and name of investigating officers. (b) There shall be a charge of One ( $1. 00) Dollar per copy of each copy of the police complaint report made. Such charge is to be paid in cash to the Chief of Police, or his representative, and shall be deposited in the general fund of the City. (c) The authorization set out in this section shall not apply to reports indicating identification and description of witnesses, synopsis of confessions, officer' s speculation as to suspect' s guilt, officer' s view of witnesses ' credibility, statements by informants, ballistics reports, fingerprint comparisons, blood and other lab tests, results of polygraph tests, refusal to take polygraph test, paraffin test results, spectrographic or other investigative reports or personal history and arrest records of those accused of offenses.
