Ord 14-90 3/6/1990 • Ordinance No. 14-90 ORDINANCE AMENDING SECTION 7-16, PARAGRAPH (31) OF ORDINANCE 41-89, CHANGING THE COMPOSITION, TERMS OF OFFICE, AND QUORUM OF THE BUILDING CODE BOARD OF ADJUSTMENTS AND APPEALS WHEREAS, it is the desire of the City Council to modify the present composition of the Building Code Board of Adjustments and Appeals; and WHEREAS, such action will allow a better representation of the construction industry, business community, and citizens affected by the Building Code. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: Section 7-16, paragraph 31 of Ordinance No. 41-89 is hereby amended to read as follows: "A105. 4 . 1 Appointment. There is hereby established a board to be called the Building Code Board of Adjustments and Appeals, which shall consist of nine (9) members. Such board shall be composed of one (1) architect (currently licensed under the Texas Architectural Practices Act) , one (1) engineer (currently licensed under the Texas Engineering Practices Act) , two (2) general building contractors, two (2) at- large members from the home building industry, two (2) at-large citizen members not connected with the construction industry, and one (1) representative from the general business or property insurance industry. A105.4 .2 Terms of Office. Of the members first appointed, three (3) shall be appointed for a term of one (1) year, three (3) shall be appointed for a term of two (2) years, and three (3) shall be appointed for a term of three (3) years; thereafter, they shall be appointed for terms of three (3) years. Terms shall expire on December 31; however, a member shall continue to serve until his successor is appointed. Vacancies shall be filled for an unexpired term in the manner in which original appointments are required to be made. Continued absence of any member from regular meetings of the Board shall, at the discretion of the City Council, render any such member liable to immediate removal from office. -2- A105.4. 3 . Quorum. Five (5) members of the Board shall constitute a quorum. In varying the application of any provisions of this Code or in modi- fying an order of the Building Official, affirmative votes of the majority present, but not less than five (5) affirmative votes, shall be required. A board member shall not act in any case in which he has a personal or financial interest. A105.4 . 6. Board Acting In An Advisory Capacity. In addition to acting on appeals, the Board shall act as an advisory board on matters of Building Code requirements, modifi- cations or amendments. In such capacity, the Board may hear evidence of any proposals from the Building Official or other persons and may present opinions of such proposals to the City Council for further action.
