AN ORDINANCE OF THE CITY OF WICHITA FALLS, TEXAS, CLOSING AND
ABANDONING A PORTION OF A SANITARY SEWER LINE LOCATED WITHIN
LOT 1, BLOCK 1, SIKES SENTER ADDITION, WICHITA FALLS, TEXAS;
AUTHORIZING THE CONVEYANCE OF THE PORTION OF THE EASEMENT
CLOSED AND VACATED TO THE FEE OWNER; FINDING AND DETERMINING
THE MEETING THAT THIS ORDINANCE IS PASSED WAS OPEN TO THE
PUBLIC IN ACCORDANCE WITH THE LAW
WHEREAS, the City of Wichita Falls has received a request
from JMB/Urban Development Company to close and abandon a portion
of a sanitary sewer easement located within Lot 1, Block 1, Sikes
Senter Addition, Wichita Falls, Texas, to be hereinafter further
described; and,
WHEREAS, the City has determined that it is in the public
interest to close and vacate this portion of the sanitary sewer
line easement; and,
WHEREAS, the City has caused the portion of the easement to
be hereinafter closed and abandoned to be appraised for its fair
market value.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. The hereinafter described portion of a sanitary
sewer easement be and is hereby forever closed and abandoned as a
public easement:
BEING a portion of a 15 foot utility easement recorded in
Volume 12, page 40, Wichita County Plat Records. Said ease-
ment being located in the T.J. English Survey, A-354 and the
Day Land and Cattle Co. Survey, A-619 and being a portion of
Lot 1, Block 1, Sikes Senter as recorded in Volume 23 , page
16 of said County Records. Said portion of the 15 foot
utility easement being more particularly described by metes
and bounds as follows:
COMMENCING at the northeast corner of said Lot 1, said point
being the intersection of the south right-of-way line of
Midwestern Parkway and the west right-of-way line of Maple-
wood Avenue;
THENCE South 00° 32' 00" West, along said west right-of-way
line of Maplewood Ave. , 305. 00 feet to the point of curvature
of a curve to the right having a radius of 1020. 50 feet, a
central angle of 31° 00' 21" and a long chord of South 16°
02' 10" West, 545. 53 feet;
THENCE along said curve and said right-of-way line an arc
distance of 552 .25 feet to the point of tangency;
THENCE South 31° 32' 21" West, along said right-of-way line,
61. 04 feet to a point in the north line of said 15 foot
utility easement;
THENCE South 71° 34' 00" West, leaving said right-of-way and
along said north easement line, 455.74 feet to a point;
THENCE South 89° 42' 00" West, along said north easement
line, 238. 30 feet to a point;
THENCE North 21° 50' 00" West, along said easement line,
347. 90 feet to a point;
THENCE North 89° 17' 00" West, along said easement line,
180. 00 feet to the POINT OF BEGINNING;
THENCE South 00° 43' 00" West, 15. 00 feet to a point;
THENCE North 89° 17' 00" West, 110. 00 feet to a point;
THENCE North 00° 43 ' 00" East, 15. 00 feet to a point;
THENCE South 89° 17' 00" East, 110. 00 feet to the POINT OF
BEGINNING and CONTAINING 1, 650 square feet or 0. 04 acres of
land, more or less.
SECTION 2 . That in consideration of the receipt of $2,475. 00
the Mayor is hereby authorized to execute a quitclaim deed to JMB/
Urban Development Company conveying unto JMB/Urban Development
Company that portion of the sanitary sewer line easement abandoned
in Section 1 hereof.
SECTION 3. That as further consideration of the conveyance
hereby authorized, JMB/Urban Development Company, its successors
and assigns, shall forever maintain the 8" sanitary sewer line
hereinafter described:
COMMENCING at the intersection of the west right-of-way line
of Maplewood Avenue and the centerline of an existing 8"
diameter sanitary sewer line;
THENCE South 71° 34' 00" West, following along centerline of
said sewer line, 448.01 feet to a manhole;
THENCE South 89° 42' 00" West, following along centerline of
said sewer line, 244. 60 feet to a manhole, being the POINT OF
BEGINNING;
THENCE North 21° 50' 00" West, following along centerline of
said sewer line, 348. 00 feet to a manhole;
THENCE North 89° 17' 00" West, following along centerline of
said sewer line, 941.50 feet to a manhole;
THENCE North 00° 44' 00" East, 342 . 20 feet to a manhole being
the end of said 8" sanitary sewer.
SECTION 4 . It is hereby officially found and determined that
the meeting at which this ordinance was passed was open to the
public as required by law.
