Ord 27-90 5/1/1990 Ordinance No. �/'P AN ORDINANCE AMENDING CERTAIN SECTIONS OF APPENDIX C, CODE OF ORDINANCES (ZONING ORDINANCE) , WICHITA FALLS, TEXAS WHEREAS, the Planning & Zoning Commission has recommended amending certain sections of the Zoning Ordinance; and, WHEREAS, the City Council of the City of Wichita Falls deems that the proposed amendments are in accordance with the Comprehensive Land Use Plan and in the public interest. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: SECTION 1. Portions of Section 6221, Appendix C, Code of Ordinances, City of Wichita Falls, Texas, regarding the minimum off- street parking requirements for the following use classification is hereby amended to read as follows (Note: New language is shown as underlined, and deleted language is shown as str+kethreugI ) : Minimum Off-Street Use Classification Parking Requirements Dwelling un+ts7 2 spaces per dwelling unit Single Family detached & except for zero-lot residential duplex or two-family (See 5255) Dwelling, multi-family 1 space per efficiency unit 1.5 spaces per one bedroom unit 2 spaces per 2+ bedroom units Hotels and motels 17zB5-spaees-per-un+t 1 space/room for 1st 100 rooms 0.75 space/room for add. rooms • SECTION 2 . Design standards for handicapped parking facilities shall be as follows: Each parking space designated for use by the handicapped shall consist of a rectangular area not less than eight (8) feet wide with a five-foot-wide clear space which may be shared by another handicapped space, by eighteen (18) feet long, with a vertical clearance of seven and one-half (7.5) feet, shall be located in an area not exceeding a two (2) percent slope, and shall be located near and convenient to a level or ramped entrance accessible to handicapped per- sons. Parking spaces for the handicapped shall be signed and restricted for use by the handicapped only, as required by Section 29-124, Code of Ordinances. " SECTION 3. Sections 3080,8A, Appendix C, Code of Ordinances, City of Wichita Falls, Texas are hereby amended to read as follows: "Single Family dwellings: Five (5) feet minimum from common lot line or one (1) foot minimum from an alley except for accessory buildings which are one hundred fifty (150) square feet or less in area, in which case it is one (1) foot minimum. (Note: See Section 6210H for setback requirements for rear vehicular access. ) " SECTION 4. Sections 3140,8A; 3210,6A; 3290, 6A; 3410, 6A; 3490, 6A; and 5250 of Appendix C, Code of Ordinances, City of Wichita Falls, Texas are hereby amended to read as follows: "Single Family and duplex dwellings: Five (5) feet minimum from common lot line or one (1) foot minimum from an alley except for accessory buildings which are one hundred fifty (150) square feet or less in area, in which case it is one (1) foot minimum. (Note: See Section 6210H for setback requirements for rear vehicular access. ) " SECTION 5. Section 5350 of Appendix C, Code of Ordinances, City of Wichita Falls, Texas is hereby deleted. SECTION 6. Section 6130A of Appendix C, Code of Ordinances, City of Wichita Falls, Texas is amended to read as follows: "A. Setbacks: A structure which is in noncompliance with the setback requirements of the Zoning Ordinance may be altered in a manner that does not increase the degree of noncompliance of the particular setback requirement, as long as all other provisions of the Zoning Ordinance, such as but not limited to, building coverage and parking requirements, are met, with the following exception: A nonconforming single-family or duplex residential structure may be altered in the above manner as long as it is no closer than three (3) feet to a property line which is common with the adjacent property. Residential garages and storage buildings may be reconstructed on their original foot print, as long as the size of the structure is not expanded. " SECTION 7. The definition of Day Care Center, Limited in Section 2000 of Appendix C, Code of Ordinances, City of Wichita Falls, Texas is hereby amended to read as follows: "DAY CARE CENTER, LIMITED A facility, or use of a building or portion thereof, that pro- vides care for less than 24 hours a day for six (6) or fewer individuals. Care for an additional six (6) individuals may be provided if the facility qualifies as a Registered Family Home or Group Day-Care Home as permitted by the Texas Department of Human Resources. This term includes nursery schools, pre- schools, day care centers for children or adults, and similar uses, but excludes public and private primary and/or secondary educational facilities.
