ORDINANCE WAIVING SECTIONS 22-1(a) ( 2) , 22-1(a) ( 9) ,
22-1(a) ( 10) , 22-3 , 22-4 AND 16-16 OF THE CODE OF
ORDINANCES TO ALLOW DRIVING OF VEHICLES, MAINTENANCE OF
HORSES AND COWS, PLACEMENT OF COMMERCIAL ADVERTISING,
MAINTENANCE OF OVERNIGHT SECURITY, CONSUMPTION OF WINE
AND BEER, AND ISSUANCE OF PERMITS FOR FOOD BOOTHS
WITHOUT PAYMENT OF PERMIT FEES FOR FALLSFEST TO BE HELD
AT LUCY PARK JUNE 14 THROUGH 17, 1990.
WHEREAS, the City of Wichita Falls, Junior League, and
Streams and Valleys are co-sponsoring FallsFest in Lucy Park on
June 14-17, 1990; and,
WHEREAS, it is the opinion of the City Council that the
event can better serve the citizens if the following activities
are permitted:
- driving of vehicles on the park,
- maintenance of horses and cows on the grass,
- placement of commercial advertising,
- maintenance of overnight security,
- consumption of wine and beer,
- issuance of permits for food booths without payment of
permit fees; and,
WHEREAS, the City Council finds the circumstances involved
are exceptional, and that the requested waivers should be
granted.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WICHITA FALLS, TEXAS, THAT:
The provisions of Section 22-1(a) ( 2) of the Code of
Ordinances are hereby waived to allow the driving of vehicles or
animals over and through such portions of the park as are
reasonably necessary to conduct FallsFest at Lucy Park.
The provisions of Section 22-1(a) ( 10) of the Code of
Ordinances are hereby waived to allow the tethering and pasturing
of cows, horses, mules or domestic animals in or upon Lucy Park
as is reasonably necessary during FallsFest.
The provisions of Section 22-1(a) ( 9) of the Code of
Ordinances are hereby waived to allow the placement of commercial
advertising signs in trade for donations, for directions, for
booth identification, and for event promotion in Lucy Park during
FallsFest.
The provisions of Section 22-3 of the Code of Ordinances are
hereby waived to allow FallsFest security personnel to remain in
the park during the hours from 12:00 o'clock midnight to 5: 00
o'clock a.m. when the park is normally closed to all persons.
The provisions of Section 22-4 of the Code of Ordinances are
hereby waived to allow the possession and consumption of
alcoholic beverages in Lucy Park for the period from June 14
through June 17, 1990.
The provisions of Section 16-16 of the Code of Ordinances is
hereby waived insofar as it applies to permit fees for food
booths at FallsFest in Lucy Park on June 14 through 17, 1990.
