Ordinance No. 44-90
AN ORDINANCE OF THE CITY OF WICHITA FALLS, TEXAS, CLOSING,
VACATING, AND ABANDONING AN IRRIGATION CANAL EASEMENT IN
PROPOSED LOT 1, BLOCK 2, J. M. CARSON SUBDIVISION, WICHITA
FALLS, TEXAS; AUTHORIZING THE CONVEYANCE OF THE EASEMENT
CLOSED, ABANDONED, AND VACATED TO THE FEE OWNER; FINDING
AND DETERMINING THE MEETING THAT THIS ORDINANCE WAS OPEN
TO THE PUBLIC IN ACCORDANCE WITH THE LAW
WHEREAS, the City of Wichita Falls has received a request to
close, vacate, and abandon an irrigation canal easement located
in proposed Lot 1, Block 2, J.M. Carson Subdivision, Wichita
Falls, Texas, to be hereinafter further described; and,
WHEREAS, the easement is no longer used for irrigation canal
purposes; and,
WHEREAS, the dedication instrument filed in Volume 1430,
Page 249 of the Wichita County Deed Records has a reverter clause
attached to it; and,
WHEREAS, the City has determined that it is in the public
interest to close, vacate, and abandon this irrigation canal
easement.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. The hereinafter described irrigation canal
easement be and is hereby forever closed, vacated, and abandoned
as a public easement:
Being described as Tract No. 3, Volume 1430, Page 249,
Wichita County Deed Records.
A tract of land out of A. Dunlavy Survey, Abs. No. 60,
Wichita County, Texas, being more particularly described as
follows:
BEGINNING at a point in the south line of said Survey, 2564
feet east of the S.W. corner, said point being also 76 ft.
east of the intersection of the center line of the North
Side Canal of said District with the south line of said
Survey, at Canal Survey Station 112 plus 14 as now located;
THENCE S 88° 58' E with the south line of said Dunlavy
Survey, 374 ft. ;
THENCE North 110 ft. ;

THENCE N 21° 30' W 360 ft. to intersection with the south
line of right-of-way for said North Side Canal;
THENCE S 77° 06' W with said right-of-way line 9 ft. to the
beginning of a 95 ft. radius curve left;
THENCE with said curve 98 ft. ;
THENCE S 17° 40' W with said right-of-way line 268 ft. to
the beginning of a 295.5 ft. radius curve right;
THENCE with said curve 130 ft. to the south line of said
Dunlavy Survey;
THENCE N 88° 58' W 10 ft. to the point of beginning;
Said tract of land containing 2.23 acres, more or less.
SECTION 2. The Mayor is hereby authorized to execute a
quitclaim deed to Rocking H.B. Inc. conveying unto Rocking H.B.
Inc. the irrigation canal easement abandoned in Section 1 hereof.
SECTION 3. It is hereby officially found and determined that
the meeting at which this ordinance was passed was open to the
public as required by law.
