Ord 78-90 11/6/1990 r ORDINANCE NO. 7,--)G fD AN ORDINANCE EXTENDING THE CITY LIMITS OF THE CITY OF WICHITA FALLS, TEXAS, BY ANNEXING A CERTAIN TRACT OF LAND ADJACENT TO THE TERRITORIAL LIMITS OF THE CITY OF WICHITA FALLS, TEXAS, WHICH TRACT OF LAND AND SERVICE PLAN FOR SUCH TRACT OF LAND ARE DESCRIBED IN THIS ORDINANCE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: SECTION 1. TRACT DESCRIPTION: The following tract of land located in Wichita County, Texas, be and the same is hereby ordered to be annexed and to be included within the corporate limits of the City of Wichita Falls, Texas, and the corporate limits be extended so as to include said tract of land in Wichita County, Texas, the same being described as follows: A TRACT OF LAND OUT OF DENTON COUNTY SCHOOL LAND, LEAGUE 2, BLOCKS 1 AND 12, WICHITA COUNTY, TEXAS; SAID TRACT BEING MORE SPECIFICALLY DESCRIBED AS BEGINNING at the Southwest corner of Lot 2-A Certain-Teed Products Addition, Wichita Falls, Texas; said point also lying on the North right-of-way line of Southwest Parkway; THENCE, in a Westerly direction along the north right-of-way of Southwest Parkway approximately seven hundred twenty eight (728) feet to a point for corner; said point lying on the existing city limits line established by Ordinance No. 3149; THENCE, in a Southerly direction approximately one hundred twenty (120) feet, along the city limits line established by Ordinance No. 3149 to a point for corner, said point lying on the south right-of-way line of Southwest Parkway; THENCE, in an easterly direction, along the south right-of-way line of Southwest Parkway, approximately one thousand two hundred thirty (1,230) feet to a point for curvature to the right; THENCE along said south right-of-way line of Southwest Parkway, along a curve to the right, approximately eight hundred ninety (890) feet to a point for corner, said point being on the existing city limits line established by Ordinance No. 2598; THENCE in a northerly direction approximately four hundred seventy five (475) feet along the existing city limits line established by Ordinance No. 2598 to a point for corner; THENCE in an easterly direction along the city limits line established by Ordinance 2598 approximately two hundred thirty (230) feet to a point for corner; said point lying on the city 2 limits line established by Ordinance No. 2756, and being on the west boundary of Block 2 , Briargate Estates; THENCE North along the west boundary of Block 2, Briargate Estates and along the existing city limits line established by Ordinance No. 2756 eight hundred fifty (850) feet more or less to a point for corner, said point lying on the southeasterly property line of a tract of land owned by FW&D Railroad; THENCE in a southwesterly direction approximately one thousand nine hundred thirty eight (1,938) feet along the southeasterly property line of a tract owned by FW&D Railroad to the point of BEGINNING, containing twenty five (25) acres, more or less. SECTION 2.0. SERVICE PLAN: This service plan for annexation of property to the City of Wichita Falls, Texas, has been prepared by the Planning Department of the City of Wichita Falls in conformance with the requirements of Chapter 43, Subchapter C, Section 43 . 056, Texas Local Government Code: SECTION 2.1: SERVICES TO BE PROVIDED WITHIN SIXTY (60) DAYS. A. Police Protection. Police protection personnel and equipment from the Wichita Falls Police Department will be provided to the area within sixty (60) days of the effective date of annexation, using existing personnel and equipment. B. Fire Protection. Fire protection and suppression personnel and equipment from the Wichita Falls Fire Department will be provided upon request within sixty (60) days of the effective date of annexation using existing personnel and equipment. Fire protection service to the tract will be as follows: Primary service will be provided by Fire Station No. 6, which has a response time of 3 .0 minutes. Back-up service will be provided by Station No. 8 with a response time of 5. 0 minutes. The services of the City of Wichita Falls Fire Marshall shall be provided within the same time frame. C. Solid Waste Collection. Solid waste collection shall be provided by the City of Wichita Falls Sanitation Division in accordance with Chapter 17: "Garbage, Refuse, Rubbish and Trash, " Code of Ordinances, as amended, City of Wichita Falls, within sixty (60) days of the effective date of annexation. The collection of refuse from individual properties and containers shall be made in accordance with usual Sanitation Division scheduling. The provision of refuse container receptacles shall be determined by the Sanitation Division upon request of eligible individual property owners. D. Maintenance of Water and Waste Water Facilities. Maintenance of water facilities shall be assumed by the City of Wichita Falls Public Utilities Department in accordance with Chapter 32 : "Water and Sewers, " Code of Ordinances, as amended, City of Wichita Falls, within sixty (60) days of the effective date of annexation. 3 Sanitary sewer extensions will be paid by the subdividers as additional development occurs in accordance with the city's Comprehensive Subdivision Ordinance and/or Chapter 32 : "Water and Sewers, " Code of Ordinances, as amended, City of Wichita Falls. E. Maintenance of Roads, Streets, Alleys and Street Lighting. The existing roads constructed to county standards will be improved to city standards under the Reconstruction Program when requested by the residents or when required because of increased population density due to development. Adjacent property owners will be assessed for the cost of curb and gutter. The placement of proper traffic control devices, street markers and street lights shall be made within sixty (60) days of the effective date of annexation. All traffic control devices, street markers, and street lights shall be located per the requirements of the Director of Traffic and Transportation. Maintenance of existing traffic control devices, street markers, and street lights shall become the responsibility of the City of Wichita Falls Traffic and Transportation Department within sixty (60) days of the effective date of annexation. Traffic control devices, street markers, and street lights required by additional development in the area will be provided in accordance with Chapter 27: "Streets and Sidewalks, " Code of Ordinances, as amended, City of Wichita Falls. F. Maintenance of Parks, Playgrounds, Swimming Pools, and other Publicly Owned Facilities, Buildings, or Services. Since no public parks, playgrounds, swimming pools, or other publicly owned facilities or buildings presently exist in this tract, no maintenance of such is necessary. Upon development of any of these facilities and acceptance by the city, maintenance shall become the responsibility of the City of Wichita Falls. Property owners within the annexed areas shall be afforded the opportunity to utilize all city services including, but not limited to, code enforcement, planning, legal, library, health, and parks and recreation programs within sixty (60) days of the effective date of annexation. SECTION 2.2: CAPITAL IMPROVEMENTS. All capital improvements including, but not limited to, streets, alleys, water service lines, waste water service lines, and fire hydrants, for new development shall be constructed by the developer of the tract in accordance with Appendix A "Comprehensive Subdivision Ordinance, " Code of Ordinances, as amended, City of Wichita Falls. SECTION 3.0: PUBLIC HEARINGS. In conformity with Chapter 43, Subchapter C, Section 43 .052, Texas Local Government Code, before these annexation proceedings were instituted, public hearings were held October 2 , 1990, and October 16, 1990, to provide an opportunity for all interested persons to be heard; 4 these hearings were held not more than forty (40) days nor less than twenty (20) days prior to the institution of these annexation proceedings. Notices of the public hearings were published once each in the Wichita Falls Times/Record News not more than twenty (2 0) days nor less than ten (10) days prior to each hearing. SECTION 4.0: CREATION OF NON-ANNEXED ISLAND. Annexation of this tract will cause the area directly north of it to be entirely surrounded by the city of Wichita Falls but not included within its jurisdiction. The tract is currently being used as an industrial plant and has a non-annexation agreement with the city for that purpose. In conformity with Chapter 43 , Subchapter C, Section 43 . 057, Texas Local Government Code, the city of Wichita Falls has found it to be in the public's interest not to include this isolated tract in this annexation proceeding. SECTION 5.0: EFFECTIVE DATE. Since a portion of the tract to be annexed has a non-annexation agreement with the city until December 31, 1990, this ordinance will not become effective until that date.
