AN ORDINANCE AMENDING CERTAIN SECTIONS OF APPENDIX C, CODE OF
ORDINANCES (ZONING ORDINANCE) , WICHITA FALLS, TEXAS
WHEREAS, the Planning & Zoning Commission has recommended amend-
ing certain section of the Zoning Ordinance; and,
WHEREAS, the City Council of the City of Wichita Falls deems
that the proposed amendments are in accordance with the Comprehensive
Land Use Plan, and in the public interest.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
SECTION 1.
Section 3363 , Appendix C, Code of Ordinances, City of Wichita Falls,
Texas, is hereby amended to add the following:
"Residential Uses
- Dwelling, Duplex or Two Family
- Dwelling, Single Family Detached
- Dwelling, Zero-Lot Line, Single Family, subject to the
provisions of Section 5200"
Section 3365, Appendix C, Code of Ordinances, City of Wichita Falls,
Texas, is hereby amended to read as follows:
" Each site in an LO District shall be subject to the following
development regulations, except for zero lot line dwellings:
1. Lot area: 5, 000 square feet minimum
2. Lot width: 50 ft. minimum
3 . Front setback : 25 ft. minimum
4 . Side setback interior: 5 ft. minimum
5. Side setback exterior: 25 ft. minimum, except 15 ft. minimum
for single family and duplex dwellings.
6. Rear setback:
A. Single family and duplex dwelling:
Five (5) ft. minimum from common lot line or one (1) ft.
minimum from alley.
(See Section 6500 for Accessory Structure setbacks and
Section 6210H for setback requirements for rear
vehicular access. )
B. All other uses: 5 ft. minimum.
7 . Height: Residential uses, 35 feet, maximum
All other uses: 1 story maximum not exceeding 25 ft.
8 . Building Coverage: 50% of lot area, maximum
Note: See Section 4600 for buffering requirements. "
SECTION 2 .
Section 4200 Setback, Appendix C, Code of Ordinances, City of Wichita
Falls, Texas is hereby amended to add subsection 4240 to read as
follows:
"4240 FRONT SETBACK FOR REAR ACCESS SUBDIVISIONS.
In Single-Family, Duplex, or zero lot line residential lots,
where the only vehicular access is taken from a rear alley or
private access easement, which is at least twenty (20) feet
wide, the front setback may be reduced to five (5) feet,
provided:
a. The lots abut only a residential street and not any larger
street sections.
b. The sidewalk is constructed abutting the curb and has at
least 4
feet of unobstructed width.
c. All utilities located in the front yard or the street right-
of-way are placed underground.
d. No vehicular street access or curb cut is permitted.
e. The entire block on both sides of the street between
intersecting streets is platted at one time with a statement
on the plat that front vehicular access and curb cuts are
prohibited. "
Sections 3080 (5) , 3140(5) , 3210(3) , 3290(3) , 3365 (3) , 3410 (3) , 3490
(3) , 5245, Appendix C, Code of Ordinances, City of Wichita Falls,
Texas is hereby amended to read as follows:
"Front Setback: 25 ft. minimum, except for rear access
subdivision where reduced setback as per Section 4240 shall
apply. "
SECTION 3 .
The definitions of the following terms in Section 2030, Appendix C,
Code of Ordinances, City of Wichita Falls, Texas are hereby amended
to read as follows:
"ACCESSORY BUILDING
A building for a use which is subordinate in area, extent, or
purpose to the use of the principal building. Such a use is
customarily found in connection with the main building.
ACCESSORY DWELLING
A detached dwelling unit accessory to a principal use on the
same site. "
Sections 3080 (8) (A) , Appendix C, Code of Ordinances, City of Wichita
Falls, Texas is hereby amended to read as follows:
"Single family dwelling:
Five (5) ft. minimum from common lot line or one (1) ft.
minimum from alley.
(See Section 6500 for Accessory Structure setbacks and

Section 6210H for setback requirements for rear
vehicular access. ) "
Sections 3140 (8) (A) , 3210 (6) (A) , 3290 (6) (A) , 3410 (6) (A) , 3490 (6) (A) ,
and 5250, Appendix C, Code of Ordinances, City of Wichita Falls,
Texas is hereby amended to read as follows:
"Single family and duplex dwelling:
Five (5) ft. minimum from common lot line or one (1) ft.
minimum from alley.
(See Section 6500 for Accessory Structure setbacks and
Section 6210H for setback requirements for rear
vehicular access. ) "
Section 6500 Accessory Use Regulations, Appendix C, Code of
Ordinances, City of Wichita Falls, Texas is hereby amended to add
Section 6516 in numerical order to read as follows:
"6516 ACCESSORY BUILDING SETBACKS
Front setback: 25 ft. minimum, except for rear access
subdivisions where reduced setbacks as
per Section 4210 shall apply.
Side setback interior: 5 ft. minimum, except when the wall
height exceeds 8 ft. or the total
height exceeds 15 ft. , the setback
shall be equal to the total height.
Side setback exterior; 15 ft. minimum
Rear Setback: From alley, 1 ft. minimum
From common property line as follows:
1 ft. minimum for buildings equal to or
less than 150 sq. ft. in area, 8 ft. in
wall height, and 15 ft. in total
height.
5 ft. minimum for buildings more than
150 sq. ft. in area, except when the
wall height exceeds 8 ft. or the total
height exceeds 15 ft. , the setback
shall be equal to the total height. "
SECTION 4.
Section 5325 Common Open Space, Appendix C, Code of Ordinances, City
of Wichita Falls, Texas is hereby deleted.
SECTION 5.
Section 5240A, Appendix C, Code of Ordinances, City of Wichita Falls,
Texas is hereby amended to read as follows:
"The minimum width of the side setback shall be ten (10) feet.
The same side setback requirements shall be observed by
accessory structures. "
Section 5240E, Appendix C, Code of Ordinances, City of Wichita Falls,
Texas is hereby amended to read as follows:
"The side setback shall be shown by building limit lines on the
subdivision plat. Easements for maintenance, drainage and roof
overhangs shall be established by notation on the plat. "
Section 5260, Appendix C, Code of Ordinances, City of Wichita Falls,
Texas is hereby deleted.
Section 5265, Appendix C, Code of Ordinances, City of Wichita Falls,
Texas is hereby deleted.
SECTION 6.
Sections 3080 (9) , 3140 (9) , 3210(8) , and 3843 (8) , Appendix C, Code of
Ordinances, City of Wichita Falls, Texas are hereby amended to read
as follows:
"Building Coverage: 50% of lot area, maximum"
Sections 3290 (8) and 3410 (8) , Appendix C, Code of Ordinances, City of
Wichita Falls, Texas are hereby amended to read as follows:
"Building Coverage: 55% of lot area, maximum, except 50% of lot
area, maximum for single-family and duplex dwellings. "
Section 3490 (8) , Appendix C, Code of Ordinances City of Wichita
Falls, Texas is hereby amended to read as follows:
"Building Coverage: No maximum, except 50% of lot area maximum,
for single family and duplex dwellings. "
SECTION 7.
If any section, subsection, sentence, clause or phrase of this
ordinance is for any reason, held to be invalid or unconstitutional,
such invalidity or unconstitutionality shall not affect the validity
or constitutionality of the remaining portions of this ordinance, it
being hereby expressly declared that this ordinance and each
section, subsection, sentence, clause and phrase hereof would have
been prepared, proposed, adopted, approved and ratified irrespective
of the fact that any one or more other sections, subsections,
sentences, clauses or phrases be declared invalid or unconsti-
tutional.
