Ordinance making an appropriation to the Special Revenue Fund for
a Tobacco Prevention and Control Coalition Grant in the amount of
$36,666 from Wichita County and authorizing the City Manager to
execute a contract accepting said funds
WHEREAS, Wichita County has a 20% smoking rate which is higher than the
State and National average;
WHEREAS, Wichita County has a high rate of poor health outcomes associated
with tobacco related illness;
WHEREAS Wichita County desires to enter into a contract for the Tobacco
Prevention and Coalition grant; and
WHEREAS, approval of these funds could not have been anticipated prior to the
adoption of the 2013 - 2014 budget.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
There is hereby appropriated in the Special Revenue Fund $36,666 for the
Tobacco Prevention and Control Coalition Grant, and the City Manager is authorized to
enter into a contract with Wichita County for the Wichita Falls-Wichita County Health
District for the receipt and administration of said funds.

Interlocal Agreement between
Wichita County and the Wichita Falls-Wichita County Public Health District & City of
Wichita Falls for County Portion of Local Funding Match for Tobacco Prevention and Control
Coalition Grant
WHEREAS, the Wichita Falls-Wichita County Public Health District (District) applied for
funding from the Texas Department of State Health Services for a Tobacco Prevention and Control
Coalition (TPCC) Grant funded by the Tobacco Settlement Fund, which will fund four new full-time
positions within the District to provide community-planned, evidence-based tobacco prevention and
control strategies, and the District was awarded the TPCC Grant in an amount of approximately
$336,500 per year for a period of 5 years;
WHEREAS, the District and City have tentatively agreed to accept the initial 7.5 months of
the TPCC Grant, but the TPCC Grant is subject to a 25% matching funds requirement, which the
City and Wichita County (County) intend to split; and
WHEREAS, the County has agreed to provide $36,666 for the initial year of funding the
County's share of required matching funds for the TPCC Grant program;
NOW THEREFORE, this agreement establishes a mechanism for the City, County, and
District to split the aforementioned funding obligation, as follows:
1. Funding: The County will provide to the District $36,666 for the current calendar year of funding
the County's share of the matching funds for the aforementioned Grant. The County's obligation
will be reduced by $9,718 in the event the City and District fail to accept funding for final quarter of
the current calendar year. If the City fails to renew the TPCC Grant for the final quarter of the
calendar year, if the City has received the $9,718, then the City will return the aforementioned
$9,718 to the County on or before October 3151 of the calendar year in which the City declines to
accept the TPCC Grant.
2. Administration of the TPCC Grant & Payment of County Funding: The District and City will
administer the TPCC Grant. Payment is due within 30 days after invoice.
3. District Updates to the County:
a. The District will provide an update on programmatic and financial activities as requested
by the County each year during the budget process. Wichita County may request additional
reports, as it deems necessary.
b. The District will provide copies of monthly & quarterly financial reports to the County
Judge.
c. The District will provide copies of the quarterly programmatic reports to the County Judge.
d. The District will provide a plan of activities to reduce costs in the indigent care program
specific to the TPCC program, including its methodology used to achieve the activities. The
Health District will provide quarterly outcome reports on these activities.

4. Term & Renewal: This agreement shall become effective when executed by the agreeing
officials, and shall be effective until December 31' of the current calendar year unless the TPCC
Grant is terminated during the calendar year. Unless (1) the TPCC Grant is terminated or not
renewed, (2) this agreement is terminated, (3) any party notifies the other party of its intent to not
renew this agreement, or (4) the County fails to fund this agreement in the calendar year of the
TPCC Grant, then this agreement shall automatically renew for subsequent annual periods during the
five-year period of expected funding of the TPCC Grant.
5. No Third-Party Beneficiaries: The benefits of this agreement are intended to inure solely to the
parties to this agreement. Accordingly, the parties do not intend any entities that are not named in
this agreement to have authority to enforce any provision of this agreement.
6. No Partnership or Joint Venture. This agreement is not intended to create and does not create a
partnership or joint venture between the parties.
7. Exclusive Venue & No Attorney's Fees: This agreement is to be performed in Wichita County,
which shall be the exclusive venue for any legal proceedings related to this agreement. In no event
will any party be entitled to any attorney's fees for any action to enforce any part of this agreement.
8. Interlocal Agreement Conditions: The parties hereto find that (a) the services performed by
each of them are necessary and authorized for activities that are properly within their statutory
functions and programs; (b) they have the authority to contract for the services; (c) they have all
necessary power and have received all necessary approvals to execute and deliver this agreement;
and (d) the representatives signing this agreement on their behalf have authority from their
respective governing bodies to sign this agreement.
