AN ORDINANCE NOMINATING TWO AREAS AS ENTERPRISE ZONES PURSUANT
TO THE TEXAS ENTERPRISE ZONE ACT (TEXAS CIVIL STATUTES, ARTICLE
5190.7) ; PROVIDING TAX INCENTIVES; DESIGNATING AN AUTHORIZED
REPRESENTATIVE TO ACT IN ALL MATTERS PERTAINING TO THE
NOMINATION AND DESIGNATION OF THE AREAS DESCRIBED HEREIN AS
ENTERPRISE ZONES; AND FURTHER DESIGNATING A LIAISON TO ACT ON
ALL MATTERS PERTAINING TO THE ENTERPRISE ZONE ACT ONCE
DESIGNATED BY THE TEXAS DEPARTMENT OF COMMERCE.
WHEREAS, the city desires to create the proper economic and
social environment to induce the investment of private resources in
productive business enterprises located in severely distressed areas
of the city and to provide employment opportunities to residents of
such areas; and,
WHEREAS, certain conditions exist in such areas which represent
a threat to the health, safety, and welfare of the people of the
areas; and,
WHEREAS, it is necessary and in the best interest of the city to
nominate such areas as an enterprise zone pursuant to the Texas
Enter-prise Zone Act (Texas Civil Statutes, Article 5190.7, the
"Act") .
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. The City hereby nominates the two areas within the
City of Wichita Falls and its extraterritorial jurisdiction, as
defined and described in Attachments A and B, and depicted on Maps A
& B, as Enterprise Zones in accordance with the Act.
SECTION 2 . The City has determined and finds that these areas
meet the qualifications of the Act.
SECTION 3 . The City will provide certain tax incentives
applicable to business enterprises in the zones which are not
applicable throughout the City as follows:
The city shall refund to any qualified business located in such
Enterprise Zones the amount of tax paid under the Municipal
Sales and Use Tax, (Texas Tax Code Chapter 321) by the business
and remitted to the Comptroller of Public Accounts to the extent
authorized by Section 12 of the Texas Enterprise Zone Act, Art.
5190.7, for a period of five years from the date the Texas
Department of Commerce certifies the entity as a qualified
business under the Act.
SECTION 4 . The City will provide additional incentives
applicable to business enterprises in the zones which are not
applicable throughout the City as follows:
A. Rebate of Development Fees. The City of Wichita Falls
Planning & Building Inspection Department will rebate permit and
development fees associated with the expansion or location of a
qualifying business within the zones. The development fee rebate
program will apply to applications for zoning changes or approvals,
subdivision plats and replats, and building related permits. The
maximum rebate will be equal to the total permit fees. The business
may apply for the rebate for a period of 12 months following State
designation as an enterprise project.
B. Special Transportation Services. The City will coordinate
with qualifying businesses within the zones to establish special
transportation service for transportation dependent employees.
C. City-Owned Property. The City will make available vacant,
surplus municipal owned buildings and property at below market value
as allowed under the Act (Sec. 20 (b) ) .
SECTION 5. The areas described in this ordinance are designated
as Enterprise Zones, subject to the approval of the Texas Department
of Commerce.
SECTION 6. The City Council directs and designates the City
Manager as the City's authorized representative to act in all matters
pertaining to the nomination and designation of the areas described
herein as Enterprise Zones.
SECTION 7. The City Council further directs and designates the
City Manager or his duly authorized designee as liaison for
communication and negotiation with the Department to oversee zone
activities and communications with qualified businesses.
SECTION 8 . A public hearing was held by the City Council on May
7, 1991, prior to considering this ordinance.
SECTION 9. This ordinance shall take effect from and after its
passage.
