Ord 047-91 5/7/1991 ORDINANCE NO. 1247-q/ AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, AMENDING CHAPTER 7 OF THE CODE OF ORDINANCES ENTITLED 'BUILDINGS' , AT SECTIONS 7-28 AND 7-29 SO AS TO DELETE THE RESPONSIBILITIES OF THE BUILDING INSPECTOR AND FIRE MARSHAL UNDER SAID SECTIONS, AND SUBSTITUTING SUCH RESPONSIBILITIES TO THE BUILDING AND CODE ADMINISTRATOR OR HIS DESIGNEE; PROVIDING FOR INCLUSION IN THE CODE; PROVIDING A REPEALER CLAUSE, AND FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS ORDINANCE IS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS: SECTION 1. That Section 7-28 of the Code of Ordinances entitled duties of the building inspector and fire marshal is hereby amended so that said section shall read as follows: "Duties of the building and code administrator or his designee. The building and code administrator or his designee shall: (a) Inspect or cause to be inspected, when necessary, all public buildings, schools, halls, churches, theaters, hotels, tenements or apartments, other multifamily residences, commercial manufacturing buildings for the purpose of determining whether any conditions exist which render such places a "dangerous building or structure" within the terms of section 7-25 of this article. (b) Inspect any building, wall or structure about which complaints are filed by any person to the effect that a building wall or structure is or may be existing in violation of this article. (c) Determine the names and current addresses of the owners and other persons having an interest in any building found to be a "dangerous building or structure" by reviewing the deed records of the county in which the structure is situated. In the event that the current addresses of the owners or other persons having an interest in the property cannot be ascertained from county deed records, the building and code administrator or his designee shall attempt to determine their current addresses by: (1) Reviewing the records and accounts of the various departments of the City of Wichita Falls; ( 2) Interviewing the occupants or owners of adjoining property; (3 ) Reviewing telephone and city directories; and ( 4) Contacting relatives of the owners and other persons having interest in the structure. (d) Provide written notice to the owner and other persons having an interest in the structure by personal service or certified mail at their current address. If the owners and other interested persons or their current address cannot be determined, such notice shall be published in a newspaper of general circulation, not less than three ( 3 ) times within a fifteen-day period. (e) Set forth in the notice provided for in subsection (d) hereof, a description of the building or structure deemed unsafe, a statement of the particulars which make the building or structure a "dangerous building," and an order requiring the same to be put in such condition as to comply with the terms of this article. Such order shall state that: (1) The owner must vacate or repair, or demolish the building or structure in accordance with the terms of this notice and this article; (2) The occupant or lessee must vacate the building or structure or may have it repaired in accordance with the notice and remain in possession; (3 ) The owner or other persons having an interest in the building or structure may at his own risk repair, vacate, or demolish the building or structure, or have such work or act done, provided that any person notified under this subsection to repair, vacate or demolish any building or structure shall be given such reasonable time, not exceeding sixty (60) days, as may be necessary to do or have done, the work or act required by the notice provided for herein. (f) Report to the city council in its capacity as building commission any noncompliance with the "notice" provided for in subsections (d) and (e) hereof. 7 '> (g) Appear at all hearings conducted by the city council in its capacity as building commission and testify as to the conditions of "dangerous building. " (h) Place a note on all "dangerous buildings" upon a determination by the city council that the structure is hazardous, reading as follows: "This building has been found to be a dangerous building by the City of Wichita Falls building and code administrator or his designee. This notice is to remain on this building until it is repaired, vacated, or demolished in accordance with the notice which has been given the owner. It is unlawful to remove this notice until such notice is complied with. " SECTION 2. That Section 7-29 of the Code of Ordinances entitled duties of the City council acting in its capacity as building commission, is hereby amended at Subsections (a) and (b) so that such subsections shall read as follows: "Duties of city council acting in its capacity as building commission. (a) Upon receipt of a report of the building and code administrator or his designee as provided for in section 7-28(f) hereof, notice shall be given as required by section 7-28(d) to the owners and all other persons having an interest in the building to appear before the commission on a date specified in the notice to show cause why the building or structure reported to be a "dangerous building" should not be repaired, vacated or demolished in accordance with the statement of particulars set forth in the building and code administrator' s (or his designee) notice provided for herein in section 7-28(e) . (b) The city council shall hold a hearing and hear such testimony as the building and code administrator or his designee and the owner, or any other person having an interest in the building, shall offer relative to the determination of the question of whether the building or structure in question is a dangerous building. " SECTION 3 . It is the intention of the City Council of the City of Wichita Falls, Texas, that the provisions of this ordinance shall become a part of the Code of Ordinances of the City of Wichita Falls, Texas, and that sections of this ordinance may be renumbered or relettered to accomplish such intention. SECTION 4. If any provision, section, subsection, sentence, clause, or phrase of this ordinance, or the application of same to any person or set of circumstances is for any reason held to be unconstitutional, void or invalid (or for any reason unenforceable) , the validity of the remaining portions of this ordinance or their application to other persons or sets of circumstances shall not be affected thereby, it being the intent of the City Council of the City of Wichita Falls in adopting and of the Mayor in approving this ordinance, that no portion hereof or provision or regulation contained herein shall fail by reason of any unconstitutionality or invalidity of any other portion, provision or regulation, and to this end all provisions of this ordinance are declared to be severable. SECTION 5 . It is hereby officially found and determined that the meeting at which this resolution is passed is open to the public as required by law and that public notice of the time, place, and purpose of said meeting was given as required.
