AN ORDINANCE AMENDING THE ZONING ORDINANCE TO AUTHORIZE SALE
OF BEER AND WINE FOR OFF-PREMISE CONSUMPTION IN A LIMITED
COMMERCIAL ZONE, SUBJECT TO THE APPROVAL OF A CONDITIONAL USE
PERMIT
WHEREAS, the Planning & Zoning Commission has recommended
amending the Zoning Ordinance to authorize beer and wine sales for
off-premise consumption in a Limited Commercial zone, subject to
the approval of a conditional use permit; and,
WHEREAS, the City Council of the City of Wichita Falls, Texas
deems that the proposed amendment hereafter described is in
accordance with the Comprehensive Land Use Plan and in the public
interest.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. Section 3400, Commercial Uses, of Appendix C
(Zoning Ordinance) , Wichita Falls Code of Ordinances is hereby
amended to add the following in alphabetical order:
"Alcoholic Beverage Sales, subject to the provisions of
Section 5400"
SECTION 2 . Section 5420 (3) of Appendix C (Zoning Ordinance) ,
Wichita Falls Code of Ordinances is hereby amended to read as
follows:
"OFF-PREMISE BEER & WINE SALES: Sales of wines, malt
liquors, and beers in unbroken original containers, to
consumers for off-premise consumption.
Such sales are authorized as permitted use in the GC, HC,
HI, RDD, and CBD zones. Such sales are also authorized in the
RMU and LC zones subject to the conditional use approval
process in Section 7200. "
