Ord 096-91 10/15/1991 ORDINANCE NO. f‘-`1/ AN ORDINANCE OF THE CITY OF WICHITA FALLS, TEXAS, AMENDING SECTION 2 AND SECTION 3 OF ORDINANCE NO. 1347, SO AS TO PROVIDE FOR QUARTERLY CALENDAR REPORTS AND FRANCHISE PAYMENTS FOR THE USE OF THE STREETS, ALLEYS, AND PUBLIC WAYS IN THE CITY; FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS ORDINANCE WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS: SECTION 1. That Sections 2 and 3 of Ordinance No. 1347, as amended by Ordinance Nos. 1906 and 2252, are hereby amended so that such sections shall read as follows: "Section 2. Any and all such persons, firms and corporations so engaged in such business in the City shall make quarterly reports thirty ( 30) days after the end of each calendar quarter of each and every year, sworn to by such person or a member of such firm or by the President, Treasurer or Secretary of such corporation, showing the gross amount of money received from the sale of gas within the corporate limits of the City of Wichita Falls, Texas. Said reports shall also include the number of gas sales customers; volume of gas sales in MCF; the gross revenue from gas sales; the number of transportation contracts; the volume of gas transported in MCF; and the gross revenue from the transportation contracts. A report shall be provided showing the new transportation customers added and deleted for the same periods ended as noted herein. Such person, firm or corporation making the report shall pay to the Director of Finance at the time such report is made three ( 3%) percent of the gross amounts received from the sale of gas within the City limits of the City for the preceding calendar quarter thirty ( 30) days thereafter. " "Section 3 . When such person, firm or corporation pays the franchise payment levied under Sections 1 and 2 hereof, the Director of Finance shall deliver to such person, firm or corporation or representative, a receipt for such payment for the three ( 3 ) month period, which receipt shall authorize such person, firm or corporation to use and occupy the streets, alleys and public ways of the City of Wichita Falls, Texas, in carrying on business for the quarter in which payment is due and paid. " SECTION 2. It is hereby officially found and determined that the meeting at which this resolution is passed is open to the public as required by law and that public notice of the time, place, and purpose of said meeting was given as required.
