A ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WICHITA
FALLS AMENDING ORDINANCE NO. 106-91 TO LIMIT THE
PROPOSED REDISTRICTING PLAN PREVIOUSLY SUBMITTED TO THE
JUSTICE DEPARTMENT FOR USE IN THE MAY 2, 1992 GENERAL
ELECTION ONLY; DECLARING AN EMERGENCY; AND FINDING AND
DETERMINING THAT THE MEETING AT WHICH THIS ORDINANCE
WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW.
WHEREAS, on the 20th day of December, 1991, the City Council
of the Home Rule City of Wichita Falls, Texas, by Ordinance No.
106-91, adopted a plan of redistricting to comport with federal
constitutional requirements on one-person-one-vote and to
guarantee the principles under the Fourteenth Amendment and the
Voting Rights Act of 1965, as amended in 1982. Specifically, it
was the intent of the Council to adopt a plan that did not have
the purpose and would not have the effect of diluting the
minority voting strength. This plan was adopted in good faith
following public hearings and consultation with members of the
general public and the minority community; and,
WHEREAS, the legal counsel for the City Council now advise
that further refinement appears necessary for the plan to secure
permanent preclearance under Section 5 of the Voting Rights Act.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. In view of the pendency of the May 2, 1992,
general election, and in order to expedite consideration of the
plan submitted under Ordinance No. 106-91, the Council hereby
amends that ordinance to specifically clarify that the proposed
plan it adopts is to be used only on an interim basis for the
May, 1992 election.
SECTION 2 . The need to expedite consideration of the
redistricting plan submitted pursuant to Ordinance No. 106-91 and
in order to insure the integrity and legality of the May 2, 1992,
general election creates an emergency; therefore, this ordinance
shall become effective immediately upon its passage.

SECTION 3 . It is hereby officially found and determined
that the meeting at which this ordinance was passed was open to
the public as required by law.
