Ord 050-92 6/23/1992 CERTIFICATE FOR ORDINANCE THE STATE OF TEXAS COUNTY OF WICHITA • CITY OF WICHITA FALLS We, the undersigned officers of the City Council of said City, hereby certify as follows: 1 . AThr, City Council of said City convened in SPECIAL MEETING ON THE d/ DAY OF JUNE, 1992, at the regular designated meeting place, and the roll was called of the duly constituted officers and members of said City Council, to-wit: Michael Lam, Mayor David Farabee Paul Hughes, Mayor Pro-Tem Harold Hawkins Wilma J. Thomas, City Clerk J. W. Martin Angus Thompson Terry Loughry and all of said persons were present, except the following absentees: None, thus constituting a quorum. Whereupon, among other business the following was transacted at said Meeting: a written ORDINANCE CALLING AN ELECTION was duly introduced for the consideration of said City Council and read in full. It was then duly moved and seconded that said Ordinance be passed; and, after due discussion, said motion, carrying with it the passage of said Ordinance, prevailed and carried by the following vote: AYES: All City Council members present above voted "Aye. " NOES: None. 2. That a true, full, and correct copy of the aforesaid Ordinance passed at the Meeting described in the above and foregoing paragraph is attached to and follows this Certificate; that said Ordinance has been duly recorded in said Board' s minutes of said Meeting; that the above and foregoing paragraph is a true, full, and correct excerpt from said Board' s minutes of said Meeting pertaining to the passage of said Ordinance; that the persons named in the above and foregoing paragraph are the duly chosen, qualified, and acting officers and members of said City Council as indicated therein; that each of the officers and members of said City Council was duly and sufficiently notified officially and personally, in advance, of the time, place, and purpose of the aforesaid Meeting, and that said Ordinance would be introduced and considered for passage at said Meeting, and each of said officers and members consented, in advance, to the holding of said Meeting for such purpose; and that said Meeting was open to the public, and public notice of the time, place, and purpose of said Meeting was given, all as required by Vernon' s Ann. Civ. St. Article 6252-17. 3. That the ordinance has not been modified, amended or repealed and is in full force and effect on and as of the date hereof. ORDINANCE CALLING AN ELECTION • THE STATE OF TEXAS • COUNTY OF WICHITA • CITY OF WICHITA FALLS WHEREAS, the City Council of said City has heretofore on the 1st day of June, 1992 adopted a resolution authorizing and directing notice of its intention to issue the tax and revenue certificates of obligation herein authorized to be issued,pursuant to Section 271.041 et. seq., Local Government Code, Vernon's Texas Codes Annotated; and WHEREAS,said notice was published as required by said Article 2368a-1 V.A.T.C.S. in the "Times Record News", which is a newspaper of general circulation in said City, in its issues of June 2, 1992 and June 9, 1992; and WHEREAS, the City received a petition from the qualified electors of the City of Wichita Falls protesting the issuance of such Certificates of Obligation; and WHEREAS, the City Council of said City deems it advisable to call the election hereinafter ordered on the question of the issuance of the Certificates of Obligation pursuant to Section 271.049, Local Government Code and in accordance with Article 701 et seq, V.A.T.C.S.; and WHEREAS, it is hereby officially found and determined that holding the hereinafter called election on a date other than a uniform election date established by Section 41.001 (a), Texas Election Code, is in the public interest; and that said meeting was open to the public, and public notice of the time, place and purpose of said meeting was given, all as required by Vemon's Ann. Civ. St. Article 6252-17. THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS: 1. That an election shall be held between the hours of 7:00 A.M. and 7:00 P.M. on the 25th day of July, 1992 in said City in the several regular election precincts of said City, at the several regular polling places, and with the Presiding Judges and Alternate Presiding Judges, as set forth in "Exhibit A" which is attached hereto and made a part of this Ordinance for all purposes. 2. That each Presiding Judge shall appoint not less than two qualified election clerks to serve and assist in conducting said election; provided that in each instance where the Presiding Judge actually serves as expected, the Alternate Presiding Judge shall be one of such clerks. 3. That by approving and signing this Ordinance the Mayor of said City officially confirms his appointment of said election officers to serve at said election; and by passing this Ordinance the governing body of said City approves and concurs in the appointment of said election officers. 4. That early voting shall be conducted by personal appearance and by mail at the City Clerk's Office, City Hall, Wichita Falls,Texas 76307,and during the period early voting is required or permitted by law, being July 6, 1992 through July 21, 1992, the hours designated for early voting by personal appearance shall be from 8:00 A.M. to 5:00 P.M. on each day except Saturdays, Sundays and legal state holidays; and the early voting clerk shall keep said early voting place open during such hours for early voting by personal appearance. The early voting clerk for said election shall be Mrs. Wilda Thomas. 5. That an early ballot board is hereby created to process early voting results, and Mrs. Iwilda Mitchell is hereby appointed the presiding judge of said board. The presiding judge shall appoint at least two other members of the board. 6. That all resident, qualified electors of the City shall be entitled to vote at said election. 7. That notice of said election shall be given by posting a substantial copy of this Ordinance at the City Hall and at three other public places in said City, not less than 15 days prior to the date set for said election; and a substantial copy of this Ordinance also shall be published on the same day in each of two successive weeks in a newspaper of general circulation published in said City, the date of the first publication to be not less than 14 days prior to the date set for said election. 8. That at said election the following PROPOSITION shall be submitted in accordance with law: Shall the City Council of said City be authorized to issue the Certificates of Obligation of said City, in one or more series or issues, in the aggregate principal amount of$4,000,000 with the Certificates of Obligation of each such series or issue, respectively, to mature serially within not to exceed 20 years from their date, and to be sold at such prices and bear interest at such rates as shall be determined within the discretion of the City Council, for the purpose of paying in whole or in part the City's contractual obligations to construct, equip and purchase land for a Multi-Purpose Event Center, to be constructed with Wichita County, and for paying legal, fiscal, architectural and engineering fees in connection with this project, with said Certificates of Obligation to be secured by and payable from any and all undesignated surplus City revenues from the City's portion of the net revenues of the Multi-Purpose Event Center, remaining after payment of all operation and maintenance expenses thereof, and all debt services, reserve, and other requirements in connection with any of the City's revenue bonds or other obligations (no or hereafter outstanding), which are payable from all or any part of the City's interest in the net revenues of the Multi-Purpose Event Center consisting of "Surplus Revenues" and the levy and collection of ad valorem taxes in the City as provided by law? 9. That the official ballots for said election shall be prepared in accordance with the Texas Election Code so as to permit the electors to vote "FOR" or "AGAINST' the aforesaid PROPOSITION, with the ballots to contain such provisions, markings and language as required by law, and with such PROPOSITION to be expressed substantially as follows: PROPOSITION FOR ) THE ISSUANCE OF $4,000,000 AGAINST ) OF CERTIFICATES OF OBLIGATION 10.
