AN ORDINANCE WAIVING THE THREE HUNDRED FEET. SEPARATION
REQUIREMENT FOR A CHURCH, FOR AN ALCOHOLIC BEVERAGE PERMIT
FOR OFF-PREMISE CONSUMPTION, AT 811 NORTH EASTSIDE DRIVE,
WICHITA FALLS, TEXAS
WHEREAS, the door of an establishment selling alcoholic
beverages for off-premise consumption must be at least 300 feet from
the nearest door of a church; and,
•
WHEREAS, Section 109 . 33 (e) of the Texas Alcoholic Beverage Code
grants the governing body of cities the authority to waive this
requirement under certain circumstances; and,
WHEREAS, the distance between the street pavement and street
right-of-way oa Jefferson Street is unusually large, creating an
unique situation with regard to the measurement of the 300 feet
separation; and,
WHEREAS, the City Council deems that waiving the separation
requirements in this case will not be detrimental to the public
health, safety, and welfare.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
Section 5430 of the Zoning Ordinance, which prohibits the sale of
alcoholic beverages within 300 feet of a church is hereby waived for
811 North Eastside Drive, Wichita Falls, Texas.
