ORDINANCE WAIVING SECTIONS 22-1 (a) (2) ° 22-3,
22-4, AND SECTION 16-16 OF THE CODE OF ORDINANCES
AND WAIVER OF RESOLUTION 2509 AS AMENDED, TO PERMIT ANIMALS
ON THE GRASS, ACCESS BEYOND CURFEW, ALCOHOLIC BEVERAGES, AND
NON-PAYMENT OF PERCENTAGE OF GROSS SALES TO THE CITY
DURING FALLSFEST* IN LUCY PARK SEPTEMBER 25 - 27, 1992'
WHEREAS, the City of Wichita Falls, and Junior League are co-
sponsoring FallsFest in Lucy Park an September 25-27, 1992; and
WHEREAS, it is the opinion of the City Council that the event can
better serve the citizens if the following activities are permitted:
-animals on the grass,
-access beyond curfew
-consumption of wine and beer;
-issuance of permits for food booths without payment
of permit fees; and
-sales without the percentage of gross sales paid to
the City.
WHEREAS, the City Council finds the circumstances involved are
exceptional , and that the requested waivers should be granted .
N8W, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WICHITA FALLS, TEXAS, THAT:
The provisions of Section 22-1 (a) (2) of the Code of Ordinances
are hereby waived to permit animals on the grass as is reasonably
necessary to conduct FallsFest at Lucy Park .
The provisions of Section 22-3 of the code of Ordinances are
hereby waived to allow FallsFest security personnel access to the park
and to remain in the park after curfew during the hours from 12:00
o 'clock midnight to 5:00 o 'clock a.m~ when the park is normally closed
to all persons.
The provisions of Section 22-4 of the Code of Ordinances are
hereby waived to allow alcoholic beverages in Lucy Park for the period
from September 25 through September 27, 1992.

The provisions of Section 16-16 of the Code of Ordinances is
hereby waived insofar as it applies to permit fees for food booths at
FallsFest in Lucy Park on September 25 through September 27, 1992.
Resolution 2509 as amended is hereby waived to allow non-payment
of the percentage of gross sales due the City~
