ORDINANCE TO APPROVE WAIVER OF SECTION 9 (F) 1)
OF SUBDIVISION ORDINANCE FOR LOT 1, BLOCK 6,
SUMMIT VIEW ESTATES FOR WATER SUPPLY SYSTEM
WHEREAS, the owner of property near the intersection of
Hammon and Hatton Roads is seeking to plat a parcel as Lot 1,
Block 6, Summit View Estates;
WHEREAS, Section 9 (F) (1) of the Subdivision Ordinance
requires a subdivision to be provided with a water supply system;
WHEREAS, the property is question is outside the city limits
but within the extraterritorial jurisdiction of the City of
Wichita Falls and is approximately 4,500 feet from the nearest
water supply source; and,
WHEREAS, the approximate cost to the customer of $50, 000 and
to the City of $20, 000 for extension of the water supply system
is not reasonable in view of the sparse development in the area
of the property.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WICHITA FALLS, TEXAS, THAT:
The requirements of the subdivision ordinance in Section
9 (F) (1) as it pertains to the requirement to supply a water
supply system to Lot 1, Block 6, Summit View Estates is hereby
waived. If the property owner subsequently desires to have water
service and is qualified
, the owner shall be responsible under other= . .ovisions of the
Code of Ordinances to pay 100% of the coat of he e.
