Ord 102-92 12/1/1992 ORDINANCE NO. /6; --J71.., A ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WICHITA FALLS CALLING FOR A SPECIAL ELECTION FOR JANUARY 16, 1993 , TO SUBMIT PROPOSED AMENDMENTS TO THE CITY CHARTER OF THE CITY OF WICHITA FALLS; SETTING FORTH THE PROPOSED AMENDMENTS; PRESCRIBING THE FORM OF THE PROPOSITIONS; NAMING ELECTION OFFICIALS AND POLLING PLACES; FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS ORDINANCE WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW. WHEREAS, in accordance with Section 9 . 004 (a) of the Texas Local Government Code, the City Council hereby calls for the submission of proposed charter amendments to the voters of the City of Wichita Falls; and, WHEREAS, the City Clerk has advised the City Council that the next authorized date to call a special election to consider the proposed charter amendments is January 16, 1993 . NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS: SECTION 1. It is hereby ordered that a special election is to be held in the City of Wichita Falls on January 16, 1993 , for the purpose of submitting to the qualified voters the hereinafter described proposed charter amendments. Such election shall be held at the polling places named in Exhibit A attached hereto. Furthermore, the persons shown on Exhibit A are hereby appointed presiding election judges, alternative presiding election judges, central counting station judge, and ballot board judge. Each presiding election judge shall appoint not less than two nor more than four election clerks to assist them in the conduct of the election. Voters residing in the City limits of Wichita Falls, Texas, within the County precinct numbers shown on Exhibit A shall vote in the City polling places shown on such exhibit. SECTION 2 . There shall be submitted at such special municipal election on January 16, 1993 , the following measures as proposed amendments to the City Charter of the City of Wichita Falls: Measure No. 1. That Section 10 of the City Charter be amended so that such section shall read as follows: "Section 10. The City Council shall consist of a Mayor and six Councilors. The Mayor shall be elected from the City at large; the other six Councilors shall be elected from six single-member districts. Any candidate for Councilor from a district must receive a plurality of the votes cast for the district in which the Councilor resides. The Mayor must receive a plurality of the votes cast in the entire city. Districts One, Two and Six will stand for regular election each odd-numbered year. Districts Three, Four, Five, and the Mayor's position will stand for regular election each even- numbered year. " Measure No. 2. That Section 61 and Section 65 of the City Charter be amended so that such sections shall read as follows: "Section 61. A City Attorney, a Director of Finance and a City Clerk shall be appointed by the City Council, without definite term, and may be removed at the pleasure of such Council. Each shall appoint, and may remove, such assistants and subordinates as the City Council may authorize each to employ. All other directors and heads of departments and officers shall be appointed by the City Manager on the basis of executive and administrative ability, and education, training and experience in the work which they are to administer. All such officers shall be immediately responsible to the City Manager, and may be removed by him at any time. In the case of the removal, if the officer so demands, a written statement shall be made by the City Manager of the reasons therefore [therefor] , and the officer shall be given a public hearing by the City Manager before the order of removal is made final. The statement of the City Manager and the written reply of the officer thereto shall be filed as a public record in the office of the City Clerk. All other employees of the City, unless otherwise provided herein, shall be appointed by, or under the direction and supervision of, the City Manager, who shall have authority to discharge any such employee, with or without cause at any time. " "Section 65. The City Manager shall have the power to appoint a Director of Finance to have supervision over the department of finances and to administer the financial affairs of the City, including the levy, assessment and collection of taxes, or other revenues, and the custody and disbursement of City funds and money. " i Measure No. 3. That Section 12 of the City Charter, previously repealed, be added to the Charter so that such Section shall read as follows: "Section 12 . A council member or mayor can serve a maximum of three (3) successive terms in the same office; however, in no event shall an elected official of the City be eligible to be elected to more than ten (10) consecutive years in any combination of elective office. After at least a two (2) year absence from office, the person will be eligible to hold an elective office with the City again. " SECTION 3. The proposed measures to amend the Charter of the City of Wichita Falls, as proposed in Section 2 of this ordinance, shall be submitted to the qualified voters at the special election on January 16, 1993 , on the ballot and in the form of the following propositions. The numbers of the propositions shall correspond to the numbers of the measures, and the words "YES" and "NO" shall be printed to the left of each proposition on the ballot: Proposition No. 1. Shall Section 10 of the City Charter be amended so that the City Council shall consist of a Mayor elected at-large, and six Councilors elected from single-member districts? Proposition No. 2 Shall Section 61 and Section 65 of the City Charter be amended so as to provide that the Director of Finance, in addition to the City Attorney and City Clerk, be appointed by the City Council? PP Y Y Proposition No. 3 Shall a new Section 12 to the City Charter be provided, restricting council and mayoral terms of office to three (3) successive terms, or a maximum of ten (10) consecutive years in any combination of elective office? SECTION 4. It is hereby officially found and determined that the meeting at which this ordinance was passed was open to the public as required by law.
