A ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
WICHITA FALLS PROVIDING THAT THE CODE OF OR
ORDINANCES OF THE CITY OF WICHITA FALLS, TEXAS, BE
AMENDED BY ADDING SECTION 27 TO CHAPTER 20,
PROHIBITING THE MANIFESTING FOR THE PURPOSE OF
SELLING ILLEGAL DRUGS AND CHEMICALS; REPEALING ALL
ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT
HEREWITH; PROVIDING A SAVING CLAUSE; FINDING AND
DETERMINING THAT THE MEETING AT WHICH THIS ORDINANCE
WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY
LAW; PROVIDING FOR A PENALTY; PROVIDING FOR
PUBLICATION; AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the Wichita Falls City Council is vitally
concerned over the plague of drug abuse and its associated
criminal activity which is occurring in Wichita Falls; and,
WHEREAS, the City Council recognizes that individuals,
children and whole families are disrupted and destroyed by
this evil; and,
WHEREAS, the City Council finds that it is in the best
interest of the health, safety and welfare of all the people
of Wichita Falls to enact this law; and,
WHEREAS, the drug related activity has become rampant in
parts of our City.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WICHITA FALLS, TEXAS:
SECTION 1. That the Code of Ordinances of the City of
Wichita Falls be amended by adding Section 27 to Chapter 20,
to read as follows:
"Section 20-27. Manifesting the Purpose of Selling
Illegal Drugs and Chemicals.
(a) A person commits an offense if he loiters in a
public place in a manner and under circumstances manifesting
the purpose of selling any illegal controlled substance,
dangerous drug, simulated controlled substance, or volatile
chemical. Among the circumstances that may be considered in
determining whether such a purpose is manifested are:
(1) Such person is a known drug dealer; or,
(2) Such person is at a location frequented by
persons who use, possess, or sell drugs; and,
(3) Such person repeatedly engages in conversations
with passersby, whether on foot or in a vehicle for the
purpose of inducing, enticing, soliciting, or procuring
another to illegally possess, transfer or buy any controlled
substance; or,
(4) Such person repeatedly passes to or receives
from passersby, whether on foot or in a vehicle, money,
objects, or written material for the purpose of inducing,
enticing, soliciting, or procuring another to illegally
possess, transfer or buy any controlled substance.
(b) No arrest shall be made for violation of subsection
(a) unless the arresting officer affords the person an
opportunity to explain his conduct, and it shall be an
affirmative defense to a violation of subsection (a) if it
appears at trial that the explanation given was true and
disclosed for lawful purpose.
(c) For the purpose of this section, a "known drug
dealer" is a person who, within three (3) years previous to
the date of arrest for violation of this section, has, within
the knowledge of the arresting officer been convicted for the
manufacture, sale, or delivery of any illegal controlled
substance, dangerous drug, simulated controlled substance, or
volatile chemical.
(d) An offense under this section is punishable by a
fine of not less than Two Hundred Fifty ($250. 00) Dollars nor
more than Two Thousand ($2, 000. 00) Dollars.
SECTION 2 . All ordinances or parts of ordinances in
conflict with the provisions of this ordinance are hereby
repealed.
SECTION 3 . Should any section, paragraph, sentence,
clause, phrase, or word of this ordinance be declared
unconstitutional or invalid for any purpose, the remainder of
this ordinance shall not be affected thereby.
SECTION 4. That this ordinance shall take effect
immediately from and after its passage and publication in
accordance with the provisions of the Charter of the City of
Wichita Falls, and it is accordingly so ordained.
SECTION 5. It is hereby officially found and determined
that the meeting at which this ordinance was passed was open
to the public as required by law.
