ORDINANCE AMENDING CHAPTER 26 OF THE
CODE OF ORDINANCES TO ESTABLISH A
NON-RESIDENT LIBRARY CARD FEE AND
PENALTIES FOR DETAINING LIBRARY
MATERIALS
WHEREAS, the City Council and the Library Advisory Board
desire to establish a non-resident library card fee and impose
penalties for detaining library materials:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WICHITA FALLS, TEXAS, THAT:
Chapter 26 of the Code of Ordinances is hereby amended to
add Section 26-7 (8) and Section 26-8 to read as follows:
"26-7 (8) Non-Resident Library Cards:
"When new library cards are issued, a fee of
fifteen dollars ($15.00) shall be assessed to all
individuals who reside outside the city limits of
Wichita Falls. This fee shall not apply to non-
resident property owners and their immediate family
members (i.e. , spouse and children who reside at
the same residence) who can substantiate payment of
current advalorem taxes to the City of Wichita
Falls. Library cards are valid for three years
from the date of issuance.
26-8 Detaining Library Property - Unlawful
It shall be unlawful for any person to detain any
library material or materials belonging to the city
public library for fifteen (15) days after notice
in writing from the library staff, mailed with
proper postage affixed in the United States mailed
to the last known address provided to said library
as the permanent residence of the holder of the
library card; said notice to be given only after
the expiration of time by which policy of such
library regulates the period of time said materials
may be kept. Any person violating this section
shall be punished by a fine of not less than $25. 00
and not more than $200. 00. "
