Ord 024-93 4/6/1993 ORDINANCE NO. 41-- fJ AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WICHITA FALLS PROVIDING THAT CHAPTER 4 OF THE CODE OF ORDINANCES OF THE CITY OF WICHITA FALLS, TEXAS, BE AMENDED TO ADOPT SECTION 4-9, PROHIBITING THE POSSESSION OF ALCOHOLIC BEVERAGES AT THE KEMP PUBLIC LIBRARY AND GROUNDS; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; PROVIDING A SAVING CLAUSE; FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS ORDINANCE WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW; PROVIDING FOR A PENALTY; PROVIDING FOR PUBLICATION; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Wichita Falls City Council is vitally concerned over the possession of alcohol in the Kemp Public Library and on its grounds; and, WHEREAS, the City Council recognizes that the Kemp Public Library and its grounds are for the use and benefit of the citizens of the City of Wichita Falls; and, WHEREAS, the City Council finds it is in the best interests of the citizens of Wichita Falls to enable them to best utilize this facility. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS: SECTION 1. That Chapter 4 of the Code of Ordinances of the City of Wichita Falls be amended by adopting Section 4-9 to read as follows: "section 4-9. Possession of alcoholic beverages in Kemp Public Library and on its grounds. (a) Prohibited. The possession of alcoholic beverages in the Kemp Public Library or on the grounds thereof is prohibited. Any police officer is authorized to seize and confiscate such beverages found on such property. (b) Penalty. Any person who is convicted of violating this section shall be punished by a fine not to exceed Two Hundred ($200. 00) Dollars. " SECTION 2. All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. SECTION 3. Should any section, paragraph, sentence, clause, phrase or word of this ordinance be declared unconstitutional or invalid for any purpose, the remainder of this ordinance shall not be affected thereby. SECTION 4. That this ordinance shall take effect immediately from and after its passage and publication, in accordance with provisions of the Charter of the City of Wichita Falls, and it is accordingly so ordained. SECTION 5. It is hereby officially found and determined that the meeting at which this ordinance was passed was open to the public as required by law.
