ORDINANCE NO. -4_3
ORDINANCE WAIVING APPENDIX A, SUBDIVISION
SECTION 9 (B) (2) (a) OF THE CODE OF
ORDINANCES WITH RESPECT TO PLACING CURB AND
GUTTER ON THE NORTHWEST SIDE OF EAST FORT
WORTH STREET, ADJACENT TO THE SOUTHEAST LINE
OF LOT 3 , BLOCK 15, KEMP AND NEWBY
SUBDIVISION
WHEREAS, it is the intent of the subject section of the Code
of Ordinances of the City of Wichita Falls, Texas to provide for
the proper and orderly development of land inside the city limits
and extraterritorial jurisdiction; and
WHEREAS, the granting of a waiver with respect to Appendix A
Section 9 (B) (2) (a) , which requires the construction of curb
and gutter on all interior streets and on the subdivision side of
all streets fronting part of the boundary of the subdivision,
would not be contrary to the state objective when applied to the
southeast line of Lot 3, Block 15, Kemp & Newby Subdivision.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WICHITA FALLS, TEXAS, THAT:
Said requirements for curb and gutter along the northwest
side of East Fort Worth Street, abutting the southeast line of
Lot 3, Block 15, Kemp & Newby Subdivision is hereby waived in the
case of this property.
