AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
WICHITA FALLS AMENDING SECTION 5-48 OF THE CODE OF
ORDINANCES TO PERMIT THE KEEPING OF POT BELLY PIGS
WITHIN THE CORPORATE LIMITS; FINDING AND DETERMINING
THAT THE MEETING AT WHICH THIS ORDINANCE WAS PASSED
WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW.
WHEREAS, it is the desire of certain citizens of the City
of Wichita Falls to keep and maintain pot belly pigs within
the corporate limits; and,
WHEREAS, the City Council finds that the keeping of such
animals within certain restrictions does not present any
hazards to the citizens of the City of Wichita Falls.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WICHITA FALLS, TEXAS:
SECTION 1. That Section 5-48 of the Code of Ordinances
is hereby amended to read in its entirety as follows:
"Sec. 5-48 Keeping of swine
(a) It shall be unlawful for any person to keep swine,
pigs or hogs in the corporate limits of the city, except under
the following circumstances:
1. It shall be unlawful for any person to keep,
harbor or raise more than two (2) pot belly
pigs in any one location within the city.
2 . All such pot belly pigs shall be kept indoors
at all times, other than times for evacuation
of waste materials or during exercise periods.
During the time periods the pig is permitted
outdoors, it shall be confined within the
property limits of the owner, and shall not be
left unattended.
3 . All pot belly pigs shall be spayed or neutered
on or before the age of three (3) months. No
adult pot belly pigs may be kept within the
corporate limits of the city unless their tusks
have been surgically removed and the pig has
been spayed or neutered.
4. All pot belly pigs shall receive annual
vaccinations for erysipelas. It shall be the
responsibility of the owner of the pig or the
property to forward to the Animal Control
supervisor an erysipelas vaccination
certificate from a licensed veterinarian, which
shall include the following information:
a. name and address of owner
b. description of the pig
c. date of vaccination
d. weight
e. other appropriate information
5. No person shall keep any pot belly pig in any
location within the city unless this person has
filed with the Animal Control Supervisor an
application for harboring a pot belly pig, and
such application has been approved and a permit
issued by the Animal Control supervisor. The
application must be accompanied by a check or
money order for Twenty-Five ($25. 00) Dollars,
such check or money order representing a non-
refundable fee for processing of application.
Thereafter, an annual permit fee of Twenty Five
($25. 00) Dollars shall be charged.
6. For the purposes of this section, the term "pot
belly pig" shall mean a Vietnamese pot belly
pig, and under no circumstances shall any swine
be considered a pot belly pig if its weight
exceeds ninety-five (95) pounds.
7. Should the pot belly pig die, be moved or
acquire a new owner or caretaker, it shall be
the registered owner's duty to inform the
Animal Control Supervisor of the fact within
fourteen (14) days of the event.
(b) Exceptions:
1. Veterinary facilities exempt: Veterinary
hospital, clinics and related practices of
veterinary medicine shall be exempt from the
provisions of this section.
3 . Other facilities exempt: Stock shows, livestock
auctions, slaughterhouses, public zoos,
governmental agencies (including public
schools) , laboratories and research facilities,
approved by the Director of Health, may be
exempt from the provisions of this section. "
SECTION 2 . It is hereby officially found and determined
that the meeting at which this ordinance was passed was open
to the public as required by law.
