ORDINANCE MAKING AN APPROPRIATION FROM EQUITY
ASSETS OF THE WATER AND SEWER FUND TO AN
APPROPRIATE OPERATING ACCOUNT FOR PURPOSES OF
CONDUCTING A SANITARY SEWER EVALUATION STUDY
IN RESPONSE TO EPA ADMINISTRATIVE ORDER
WHEREAS, the City has been placed under an Environmental
Protection Agency Administrative Order that requires the
prevention of overflows of raw sewage in the sanitary sewer
collection system;
WHEREAS, to properly respond to the Administrative Order,
the City must conduct a Sanitary Sewer Evaluation 'Study;
WHEREAS, the cost of the Sanitary Sewer Evaluation Study is
$2, 110, 300, and $1, 725, 000 of that amount will be taken from the
current FY 93-94 budget, leaving an unfunded amount of $385, 300;
WHEREAS, the Council desire to appropriate $385, 300 from the
Water and Sewer Fund Equity to complete the funding required for
the Sanitary Sewer Evaluation Study; and,
WHEREAS, an urgent public necessity exists to award a
contract for the stated Evaluation Study in a timely manner,
therefore the charter requirement delaying the effective date of
this ordinance for thirty days from date of passage is hereby
suspended and this ordinance shall take effect immediately upon
passage.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WICHITA FALLS, TEXAS, THAT:
There is hereby appropriated from the equity assets of the
Water and Sewer Fund an amount of $385, 300, said funds being
appropriated to operating account 81-707-4430 .
