Ord 081-94 6/21/1994 ORDINANCE NO. A ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, AMENDING APPENDIX C OF THE ZONING ORDINANCE OF THE CITY OF WICHITA FALLS AT SECTION 3400, CONDITIONAL USES; PROVIDING FOR A REPEALER CLAUSE; PROVIDING FOR INCLUSION IN THE CODE; FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS ORDINANCE WAS DISCUSSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: SECTION ' 1. Appendix C of the Zoning Ordinance of the City of Wichita Falls at Section 3400, Conditional Uses, is hereby amended so that such section shall read as follows: "3400 CONDITIONAL USES The following uses are permitted in the LCD district subject to the approval process provided in Section 7200 and to the provisions of Section 3420, Special Conditions. Residential Uses: • Dwelling, Multifamily-Family, exceeding 25 units per acre • Manufactured Homes, subject to the provisions of Section 5600 Civic Uses: • Day Care Centers, Commercial more than 1,200 sq.ft. in gross floor area • Residential Care Facility Commercial Uses: • Alcoholic Beverage Sales, subject to the provisions of Section 5400 • Art Gallery/Museum • Clinic • Club • Convenience Stores • Medical Offices, more than 1,200 sq.ft. in gross floor area • Offices, more than 1,200 sq.ft. in gross floor area • Restaurant, Limited • Retail Trade, excluding automobile sales and supermarkets. • Services, more than 1,200 sq.ft. in gross floor area, excluding automotive repair services and restaurants. " SECTION 2 . If any section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be invalid or unconstitutional, such invalidity or unconstitutionality shall not affect the validity or constitutionality of the remaining portions of this ordinance, it being hereby expressly declared that this ordinance and each section, subsection, sentence, clause and phrase hereof would have been prepared, proposed, adopted, approved and ratified irrespective of the fact that any one or more other sections, subsections, sentences, clauses or phrases be declared invalid or unconstitutional. SECTION 3 . It is the intention of the City Council of the City of Wichita Falls, Texas, that the provisions of this ordinance shall become a part of the Code of Ordinances of the City of Wichita Falls, Texas, and that sections of this ordinance may be renumbered or relettered to accomplish such intention. SECTION 4. It is hereby officially officiall found and determined that the meeting at which this ordinance was passed was open to the public as required by law.
