A ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WICHITA
FALLS, TEXAS, ORDERING THAT A SPECIAL ELECTION BE HELD
IN THE CITY OF WICHITA FALLS ON AUGUST 13, 1994, TO
SUBMIT A PROPOSITION ON THE QUESTION OF THE ADOPTION OF
AN ADDITIONAL ONE-HALF CENT SALES AND USE TAX UNDER THE
PROVISION OF SECTION 4B OF THE INDUSTRIAL DEVELOPMENT
CORPORATION ACT; FINDING AND DETERMINING THAT THE
MEETING AT WHICH THIS ORDINANCE WAS DISCUSSED WAS OPEN
TO THE PUBLIC AS REQUIRED BY LAW.
WHEREAS, the City Council of the City of Wichita Falls
hereby finds that a special election should be held for the
purpose of submitting a proposition on the levy and collection of
an additional one-half cent sales and use tax within the City
under the provisions of Section 4B, Article 5190. 6, V.A.C.S. (the
"Act") ; and,
WHEREAS, the City of Wichita Falls is authorized by law to
hold such election on August 13, 1994, and is an "eligible city"
under the provisions of Section 4B of the Act.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. All of the above preambles and recitals are
found to be true and correct and are incorporated herein for all
purposes.
SECTION 2. An election shall be held on August 13, 1994, in
the City of Wichita Falls, which date is not less than thirty
(30) days from the date of the adoption hereof, and is a uniform
election date pursuant to V.T.C.A. , Election Code, Section 41.01,
for the purpose of submitting the following measure:
"PROPOSITION. Shall the City of Wichita Falls, Texas,
adopt an additional iG (one-half cent)
sales and use tax within the City of
Wichita Falls, pursuant to the
provisions of Section 4B, Article
5190.6, V.T.C.S. , as amended, to be
applied and used for the purposes
permitted by said Section 4B?"
SECTION 3. All resident qualified electors of the City
shall be permitted to vote at said election. This election shall
be held and conducted in accordance with the provisions of
V.T.C.A. , Election Code, and V.T.C.A. , Tax Code, Subchapter E of
Chapter 321, and the Act, and as may be required by law, all
election materials and proceedings shall be printed in both
English and Spanish.
SECTION 4. Any such sales and use tax approved pursuant to
said election shall become effective October 1, 1994.
SECTION 5. Notice of the time and place of said election
shall be given by publication of such notice in a paper of
general circulation published in the City of Wichita Falls at
least thirty (30) days prior to the date of the August 13, 1994,
election.
SECTION 6. It is hereby officially found and determined
that the meeting at which this ordinance was passed was open to
the public as required by law.
